Moving the Bedroom Bathroom to the Balcony

Admin 10 de octubre de 2026

Generally, it is not feasible to move the bedroom bathroom to the balcony, mainly due to the following issues:

I. Legal and Regulatory Restrictions
According to Article 5, Item 2 of the 'Measures for the Administration of Interior Decoration and Renovation of Residential Buildings', it is prohibited to convert rooms or balconies without waterproof requirements into bathrooms. The original design of the balcony does not consider waterproofing needs, and improper waterproofing after renovation can easily lead to leakage downstairs, causing disputes among neighbors. If it involves the removal of load-bearing walls or changes to the main structure of the building (such as adding drainage pipes that require breaking the floor slab), it violates Article 5, Item 1 of the same measures, which prohibits altering the main structure and load-bearing components of the building without the consent of a professional design unit. Such actions can threaten the structural safety of the entire building. Additionally, according to Articles 288 and 296 of the 'Civil Code of the People's Republic of China', if the renovation causes noise, water leakage, or other infringements on the owners downstairs, it violates the principles for handling neighboring rights and requires legal liability.

II. Property Management Regulations
The property management regulations of residential communities typically explicitly require that owners shall not擅自 (unauthorizedly) change the original purpose of the building. As a public area or an attached functional space, any change in the use of the balcony requires approval from the property management and compliance with planning requirements. Unauthorized alterations may be subject to mandatory rectification and even fines or legal proceedings.

III. Technical Implementation Challenges
The structural design of the balcony does not reserve conditions for the installation of sanitary facilities:

  1. Lack of Drainage System: The balcony only has rainwater drainage pipes and cannot meet the sewage discharge needs of a bathroom. Renovation requires laying new pipes, which may damage the floor slab structure;
  2. Insufficient Waterproof Layer: The waterproofing standard of the balcony floor is much lower than that of a bathroom, and long-term use can easily lead to leakage;
  3. Load-Bearing Limitations: The weight of bathroom equipment (such as toilets and bathtubs) is relatively large, and the balcony floor slab may not be able to bear it;
  4. Ventilation and Lighting: Converting the balcony into a bathroom will occupy natural lighting and ventilation space, affecting the indoor environmental quality.

IV. Risks from Actual Cases
A typical case occurred in Chongqing: The owner upstairs converted the balcony into a bathroom, resulting in long-term leakage and odor downstairs, forcing the owner downstairs to suspend their renovation plans. Although the property management and law enforcement departments intervened, due to the involvement of structural safety and neighboring rights, the problem remained unresolved for a year and was only partially resolved through legal channels.

Recommendation: If you need to adjust the position of the bathroom, you should first consult the property management and a building designer to assess the structural integrity and compliance of the house. Compliant solutions include optimizing the layout within the original bathroom area or achieving functional adjustments through housing renovation (such as merging adjacent non-load-bearing wall areas), but it must be ensured that they do not violate laws, regulations, or property management regulations.
