Who Supervises Prefabricated Houses

Admin September 18, 2026

The regulatory authority for prefabricated houses primarily depends on their nature and purpose, involving multiple entities such as real estate administrative departments, housing and urban-rural development bureaus, urban planning departments, and quality supervision departments.

If prefabricated houses are pre-sold as commercial properties, the real estate administrative department is the core regulatory body. According to Article 45 of the "Urban Real Estate Administration Law of the People's Republic of China," pre-sale of commercial properties requires registration with the real estate administrative department of the people's government at or above the county level and obtaining a commercial property pre-sale permit. This provision clarifies the approval and regulatory responsibilities of the real estate administrative department in the pre-sale process of commercial properties, including reviewing developer qualifications, registering pre-sale contracts, and supervising pre-sale funds to safeguard the rights and interests of homebuyers and market order.

The Housing and Urban-Rural Development Bureau (HURDB) plays a crucial role in the full lifecycle management of prefabricated houses. Its regulatory scope covers construction aspects such as production and installation, ensuring that prefabricated houses comply with regulations such as the "Construction Law" and the "Regulations on the Quality Management of Construction Projects." For example, the HURDB reviews the qualifications of prefabricated component manufacturers, supervises the quality and safety of the construction process, and inspects completed projects to prevent safety hazards caused by design or construction defects.

The urban planning department focuses on the planning compliance of prefabricated houses. If the houses are located within urban planning areas, their location, layout, and height must comply with urban and rural planning requirements. The planning department ensures that prefabricated houses harmonize with the surrounding environment and avoid disrupting urban spatial order or violating land use regulations by issuing construction land planning permits and construction project planning permits.

The quality supervision department focuses on the physical quality of prefabricated houses. According to the "Product Quality Law" and the "Regulations on the Quality Management of Construction Projects," quality supervision agencies must conduct spot checks on the production, transportation, and installation of prefabricated components to verify compliance with national standards or industry norms. For example, they inspect key indicators such as concrete strength and steel structure anti-corrosion treatment to prevent inferior materials or processes from entering the market.

Additionally, if prefabricated houses are used for temporary buildings, affordable housing, or other special scenarios, emergency management departments, civil affairs departments, and other entities may also be involved in supervision. The diversity of the regulatory system aims to build a comprehensive regulatory network covering the entire chain of prefabricated houses through division of labor and collaboration, safeguarding public interests and the healthy development of the industry.
