What to Do with Many Container Houses
Admin September 17, 2026
Different measures should be taken to handle a large number of container houses based on their legality and specific circumstances, with the core principle being to act in accordance with laws and regulations and safeguard rights and interests.

1. Confirm Legality
- Legal container houses: If they have obtained approvals for land use, planning, etc., such as being used as temporary buildings for storage, office, and other specific purposes and approved by relevant departments, they are considered legal structures. Their legitimate rights and interests are protected by law, and they can continue to be used or receive reasonable compensation in accordance with relevant laws and regulations.
- Illegal container houses: Container houses without the necessary approvals may be identified as illegal structures. According to the Urban and Rural Planning Law of the People's Republic of China, those who fail to obtain a construction project planning permit or do not build in accordance with the permit shall be ordered to stop construction by the urban and rural planning administrative department at or above the county level.
2. Classified Handling Based on Legality
- Legal houses: If they do not affect structural safety and meet planning requirements, they can continue to be retained and used. If they need to be demolished or relocated (e.g., due to planning adjustments), compensation or arrangements should be made in accordance with the law.
- Illegal houses: Relevant departments have the right to order them to be demolished within a specified time limit. If they are not demolished within the time limit, they can be forcibly demolished and fined in accordance with the law. During the handling process, it is necessary to ensure that the procedures are legal and safeguard the rights and interests of the parties involved.
3. Special Requirements in Rural Areas
- Placement on homesteads: They must be located on confirmed homesteads. If the homestead itself is illegal or occupies someone else's homestead, the container house is illegal.
- Placement on wasteland: When placed on wastelands such as barren mountains, barren slopes, and abandoned ponds, it is necessary to consult the land management department in advance and obtain government permission before placement.
- Location restrictions: They shall not obstruct rural traffic or affect the lives of other villagers.
4. Necessary Certificates and Procedures
- Basic certificates: Land use right or lease certificate; for non-temporary uses, a construction project approval and planning permit are required.
- Safety and environmental protection: Fire protection review qualification certificate; environmental impact assessment approval.
- Specific purposes: Temporary building permit (required for temporary construction); when meeting the criteria for permanent building identification and having legal land planning, a real estate certificate may be required; for business activities, a business license and relevant permits are required.
5. Communication and Negotiation with Relevant Departments
- Understand policies: Take the initiative to contact urban and rural planning, urban management, and other departments to clarify policy requirements and handling procedures.
- Negotiate solutions: If there are objections to the handling results or special circumstances exist, you can negotiate with relevant departments to seek reasonable solutions.
