What to Do If a Container Hits a House

Admin September 16, 2026

After a container hits a house, the truck driver should immediately stop the vehicle, call the police, and follow the steps below:

  1. Stop the vehicle and call the police immediately: After the accident occurs, the truck driver should stop the vehicle as soon as possible. After ensuring personal safety, call 110 to report the accident, providing detailed information about the accident time, location, and on-site situation, and wait for the traffic police to arrive at the scene. This step is the foundation for subsequent liability determination and compensation and must be carried out as a priority.

  2. Protect the scene and collect evidence: Before the traffic police arrive, try to keep the accident scene as it is as much as possible, avoiding human-caused damage or moving key evidence such as the vehicle and house debris. At the same time, take photos and videos to record the overall scene and note down the contact information of witnesses to provide support for subsequent investigations. The integrity of the evidence directly affects the determination of liability and the amount of compensation.

  3. Cooperate with the traffic police investigation and liability determination: After the traffic police arrive at the scene, the driver should truthfully state the accident process and submit documents such as the driver's license and vehicle license. The traffic police will comprehensively judge the liability ratio based on on-site traces, witness testimonies, etc. If the house has illegal construction (such as occupying the road or not meeting standards), the driver's liability for compensation may be reduced.

  4. Determine the liable party and the amount of compensation:

    • According to Article 832 of the Civil Code, the carrier (the driver or the affiliated company) is usually liable for compensation. However, if it can be proven that the house damage was caused by force majeure, the natural properties of the goods, or the fault of the shipper, the carrier can be exempted from liability.
    • The compensation amount shall be determined based on the agreement between the two parties as a priority. If there is no agreement, it shall be based on the repair costs (material costs, labor costs, etc.) or the replacement cost of the house, and may also include indirect losses such as rental losses and liquidated damages caused by the accident. For example, in a certain case, the house needed to be demolished and rebuilt, with an assessed loss of 34,416 yuan, and an additional rental liquidated damages of 12,960 yuan needed to be compensated.
  5. Insurance claim and negotiation for settlement: If the vehicle is insured, the driver should immediately contact the insurance company to report the case and submit claim materials as instructed. The insurance company will cover part or all of the losses according to the policy terms. At the same time, the driver can negotiate a compensation plan with the house owner, presenting evidence such as the assessment report to clarify the claims. If the negotiation fails, the case can be resolved through litigation, and key evidence such as on-site photos, assessment reports, and lease contracts need to be prepared.
