Tax Policies for Leasing Container Houses

Admin September 13, 2026

Tax policies for leasing container houses must be assessed together with the property's nature, use, and local regulations. The following are common tax categories and reference principles:

I. Value-Added Tax (VAT) If the lessor is a small-scale VAT taxpayer, from January 1, 2026 through December 31, 2027, operating leases of non-residential immovable property (such as container houses used for commercial or industrial purposes) may be taxed under the simplified method at a 3% collection rate. If monthly sales do not exceed $13,889 (or quarterly sales do not exceed $41,667), VAT may be exempted. If the lessor is a general taxpayer, VAT must be calculated under the general taxation method (9% rate), but input VAT may be deducted.

II. Property Tax

  • Residential nature: If a container house is classified as residential (e.g., used for living), the lessor is charged property tax at a 4% rate; if the lessor qualifies as a small-scale VAT taxpayer, from January 1, 2023 through December 31, 2027 the tax may be halved (i.e., an effective rate of 2%).
  • Non-residential nature: If a container house is used for commercial, industrial, or other non-residential purposes, the property tax rate is typically 12%, but the specifics must be clarified further based on local regulations and the property's use.

III. Urban Land Use Tax

  • Residential use: Individuals renting out residential property are exempt from urban land use tax, subject to tax authority recognition of the container house as "residential."
  • Non-residential use: If used for commercial, industrial, or similar purposes, urban land use tax must be paid based on land grade and actual occupied area; specific rates are determined by local tax authorities.

IV. Other Taxes and Fees

  • Stamp duty: Individuals renting out residential property are exempt from stamp duty; for non-residential leases, stamp duty of 0.1% of the lease amount applies.
  • Individual income tax: Levied at a 10% rate on income from property leasing, after deducting reasonable expenses such as repair costs (up to $111 per month) and taxes when calculating taxable income.

Notes: Tax classification of container houses may vary depending on use (residential/non-residential), ownership type (individual/enterprise), and local tax authority standards. For example, some regions may treat temporarily erected container houses as "prefabricated temporary buildings" rather than "immovable property," which affects which taxes apply. Before taking action, it is advisable to consult the competent tax authority to clarify the property's nature and local policies and ensure compliant tax payment.
