Can Container Houses Be Built in Rural Areas

Admin September 16, 2026

Whether container houses can be built in rural areas depends on various factors, primarily on obtaining approvals and complying with land, planning, and construction standards.

Legitimacy Boundaries Require Meeting the “Three Elements”

  1. Compliance with Land Nature
If built on homestead land, it must adhere to the “one household, one homestead” principle, and the area should not exceed local standards (e.g., Guizhou stipulates no more than 320 square meters per household). For non-residential purposes (such as storage or processing), it is necessary to apply for collective commercial construction land quotas. Unauthorized occupation of cultivated land or permanent basic farmland for constructing container houses may face the risk of demolition (e.g., the case of a certain agricultural company in Hainan).

  2. Proper Planning Approval
When used as permanent buildings, they need to be included in rural construction planning. For example, a certain homestay in Anji, Zhejiang, formed a double-story structure by assembling containers. Due to submitting the design plan in advance and obtaining approval, it became a legal commercial building. If used as temporary buildings (such as for post-disaster relocation or construction site dormitories), some regions allow exemption from planning permits for 1-2 years, but they must be self-demolished upon expiration (e.g., the container relocation sites after the rainstorm disaster in Lankao, Henan).

  3. Meeting Construction Standards
Container houses for residential use must use Class A fire-resistant materials (such as rock wool boards), and the building area of each unit should not exceed 300 square meters. The use of flammable sandwich panels (such as foam boards), unauthorized electrical wiring, or occupation of fire exits may be identified as safety hazards and subject to forced demolition (e.g., the case of workers' dormitories in a certain residential area in Beijing).

The Legal Approval Process Requires Three Steps

  1. Land Nature Verification and Planning Application: Confirm land ownership and verify with the village committee or township natural resources office whether it is homestead land or approved construction land; if it involves cultivated land, it is necessary to go through the formalities for converting agricultural land to construction land.
  2. Submission of Planning and Design Plans: Commission a design unit to issue architectural drawings, clarifying the purpose, duration, structural safety, etc.
  3. Construction and Acceptance: Carry out construction according to the approval requirements and pass acceptance checks for fire safety, structural safety, etc., upon completion.

Container houses that have not obtained approval or have been illegally renovated (such as for long-term residence or business operations) may be identified as illegal constructions and face forced demolition, fines, and other risks. It is advisable to consult local natural resources and housing and construction departments before construction to ensure compliance.
