Installation of Mobile Indoor Toilets in Rooms

Admin September 27, 2026

The legality of installing mobile indoor toilets in rooms depends on specific circumstances. Unauthorized modifications or additions may result in legal risks.

1. Installation in Rental Properties Requires Landlord Consent

According to Article 715 of the Civil Code of the People's Republic of China, if a tenant wishes to improve or add fixtures (such as installing a mobile toilet) to the leased property, prior written consent from the landlord is mandatory. Unauthorized installation may result in the landlord's right to demand restoration to the original state or compensation for damages. For example, if the installation of a mobile toilet requires damaging the original floor or walls without the landlord's permission, it constitutes a violation.

2. Compliance with Building Structure and Usage Modifications

  1. Restrictions on Structural Modifications
    Articles 8 and 24 of the Measures for the Administration of Commercial Housing Leasing (2011 Edition) explicitly state that rental housing should use the originally designed rooms as the minimum rental units. If installing a mobile toilet requires altering the building structure (such as adding pipes or dividing spaces) or involves modifications to load-bearing structures, a plan must be proposed by the original design unit or a qualified design unit and submitted to relevant authorities for approval. Unauthorized modifications may be deemed illegal rental practices.

  2. Waterproofing and Usage Restrictions
    Article 5 of the Measures for the Administration of Interior Decoration of Residential Buildings (2011 Revised Edition) prohibits converting rooms without waterproofing requirements into bathrooms. If the original room lacks a waterproof layer (such as bedrooms or living rooms), installing a mobile toilet may damage the building structure or affect neighbors below due to potential leakage issues. Such modifications are considered violations even if the structure remains intact.

3. Compliance Requirements for Mobile Toilets Themselves

Mobile toilets typically consist of modules such as storage tanks, sanitary fixtures, and walls, offering portability. However, installation must ensure:

  1. Compliance with Building Safety Standards: Secure fixtures and safe electrical wiring;
  2. Non-Occupation of Public Spaces: If installed in common areas (such as hallways or rooftops), consent from all property owners is required;
  3. Environmental and Sanitary Requirements: Wastewater must be disposed of through compliant methods (such as connecting to municipal sewage systems or regular removal) to prevent environmental pollution.

4. Recommended Operational Procedures

  1. Confirm Property Ownership and Lease Agreement Terms to clarify whether modifications are permitted;
  2. Consult Property Management or Local Housing Authorities to understand approval requirements for structural modifications and usage changes;
  3. Commission Professional Assessments to ensure the modification plan complies with safety and legal standards;
  4. Retain All Approval Documents and Communication Records to avoid disputes.

Failure to follow these procedures may result in the installation being ordered for removal or penalties, even if the mobile toilet itself meets product standards.
