Roof Mobile Toilet

Admin September 20, 2026

The installation of roof mobile toilets without approval is an illegal act of unauthorized construction, which poses numerous risks and should not be carried out.

Legal Aspect

The rooftop terrace belongs to the public space of the residential community. According to the relevant provisions of Article 40, Paragraph 1 of the Urban and Rural Planning Law of the People's Republic of China, any construction activity requires the handling of construction planning approval procedures. However, the installation of roof mobile toilets usually does not go through any relevant procedures and is thus an illegal construction act. For example, if a resident installs a mobile toilet on the rooftop terrace without obtaining any approval for the construction facilities, it is suspected of violating this legal provision. Such illegal construction activities undermine the unity and seriousness of urban planning and disrupt the normal order of urban construction.

Safety Aspect

  • Risk of Falling Objects from High Altitudes: If a roof mobile toilet is installed close to the edge of the terrace, over long-term use, due to the influence of natural factors such as wind, sun, and rain, or human collisions, components of the toilet such as doors, windows, and decorative materials may fall off, causing falling objects from high altitudes and seriously injuring pedestrians and vehicles passing by below.
  • Risk of Structural Overloading: When designing the rooftop terrace, its load-bearing capacity is determined based on the original building structure and intended use. Installing a mobile toilet on the roof will increase the load on the rooftop. If the weight of the toilet exceeds the load-bearing capacity of the rooftop terrace, it may lead to problems such as cracks and deformations in the rooftop structure. In severe cases, it may even affect the structural safety of the entire building and endanger the lives and property of the residents in the whole building.

Public Resource Aspect

The rooftop terrace, as a public space in the residential community, is jointly owned by all the owners. Unauthorized installation of a roof mobile toilet occupies public resources and infringes on the legitimate rights and interests of other owners. Other owners are unable to use the rooftop terrace normally for leisure activities, drying clothes, etc., which disrupts the public environment and order of the residential community.
