Roof Mobile Toilet

Admin September 20, 2026

Roof mobile toilets are considered illegal constructions. The following provides a detailed explanation from three aspects: legal considerations, the nature of public areas, and safety risks.

From a legal perspective: According to the relevant provisions of Article 40, Paragraph 1 of the Urban and Rural Planning Law of the People's Republic of China, the construction of buildings, structures, and other engineering projects must obtain a construction project planning permit in accordance with the law. Roof mobile toilets are considered unauthorized construction without planning approval. Even though their structures are relatively simple and movable, as long as they have not gone through the relevant construction planning approval procedures, they violate the above-mentioned legal provisions. For example, a resident擅自 (without permission) built two aluminum alloy glass sunrooms on the rooftop terrace and illegally installed a mobile toilet. Since none of the construction facilities had obtained any construction planning approval, they were ultimately identified as illegal constructions.

Analyzing from the perspective of public area attributes: The rooftop terrace belongs to the common public area of all the owners in the residential community, not private space. According to relevant laws, regulations, and property management rules, all owners have joint rights to use and manage the public area. No owner has the right to occupy the public area for construction or renovation without authorization. The installation of a roof mobile toilet is undoubtedly an encroachment on the public area, damaging the legitimate rights and interests of other owners.

Considering safety risks: Such illegal constructions pose numerous safety hazards. On the one hand, they may cause the risk of falling objects from high altitudes. If the mobile toilet is not firmly fixed or is subjected to external forces, its components may fall from the rooftop, posing a serious threat to pedestrians and vehicles below. On the other hand, they can lead to structural overloading. The rooftop terrace is usually designed only to meet its own load-bearing requirements. The additional construction of a mobile toilet will increase the load on the rooftop. Over time, this may affect the structural safety of the building and even trigger serious accidents such as collapse.
