Roadside Mobile Toilet Stolen

Admin September 24, 2026

There are indeed cases of roadside mobile toilets being stolen. Here are specific case analyses:

Case 1: Theft of Mobile Toilets in Hefei City

On the evening of August 29, 2021, a theft of mobile toilets occurred near the intersection of Tianmen Mountain Road and Longgang Road in Yaohai District, Hefei City, Anhui Province. The reporter, Mr. Jiang, claimed that his brand-new mobile toilet (worth over 5,000 yuan) placed by the roadside had been stolen. The investigation by the Daxing Police Station of the Yaohai Branch revealed that the suspect, Mr. Xia, along with two accomplices, stole the mobile toilet that night due to the inconvenience of having many family members and inadequate toilet facilities at home. On September 1, the police recovered the stolen facilities at Mr. Xia's doorstep, and Mr. Xia confessed to the crime. In this case, the motive for theft was to meet family living needs, but the act constituted a violation of the law.

Case 2: Theft of Mobile Toilets during the Changzhou Marathon

During a marathon event in 2021, Mr. Jiang, aged 56, stole mobile toilets (worth 4,750 yuan) set up along the route after the race ended, intending to place them by the fishpond he guarded for use by anglers. That noon, Mr. Jiang transported the facilities, weighing about 200 pounds, back to the fishpond using a tricycle and returned them that evening after hearing about the search. After the incident, Mr. Jiang voluntarily surrendered and compensated 800 yuan in mailing fees, obtaining forgiveness from the provider. The court ultimately sentenced him to a fine of 5,000 yuan for theft. In this case, the motive for theft was to improve the public environment, but unauthorized taking of public property without permission still constitutes a crime.

Legal Qualification Analysis

Both cases involve theft. According to Article 264 of the Criminal Law of the People's Republic of China, theft of public or private property with a relatively large value (usually over 1,000 yuan to 3,000 yuan or more) or multiple thefts can result in imprisonment for up to three years, criminal detention, or surveillance. In these cases, the value of the mobile toilets exceeded the threshold for filing a case, and the perpetrators had the subjective intent of illegal possession and objectively carried out secret theft, meeting the constituent elements of theft. Even if the stolen items are returned or compensated afterward, criminal responsibility must still be borne, but punishment may be reduced or mitigated.

Social Implications

As public facilities, mobile toilets require enhanced anti-theft measures in their management (such as fixed installation and surveillance coverage). The public should be clear that public property cannot be disposed of arbitrarily. Even if motivated by goodwill or personal needs, one must apply for or purchase it through legal channels to avoid violating criminal law due to a lack of legal awareness.
