Rental Contract for Portable Toilets at Construction Sites

Admin October 07, 2026

The rental contract for portable toilets at construction sites falls under the category of movable property rental contracts, with core clauses covering the rental period, cost structure, damage compensation mechanism, and the rights and obligations of both parties. Special provisions need to be added based on regional characteristics.

1. Rental Period

The start and end times of equipment usage must be clearly defined, and the rental type should be selected according to the project duration:

  • Short-term Rental: Suitable for projects with a duration of less than 3 months, billed daily or weekly, offering high flexibility.
  • Long-term Rental: Recommended for projects with a duration exceeding 3 months, with discounts available (e.g., an 8-9% discount for long-term rentals in Nanping).

2. Cost Structure

The costs typically consist of four parts, which should be negotiated and determined based on regional market prices:

  1. Basic Rental Fee:
    • The average price in Nanping ranges from 300 to 800 yuan per day, with significant discounts for long-term rentals; in Yiyang, the basic model costs 15 to 30 yuan per unit per day, while the high-end model costs 40 to 60 yuan per unit per day; in Xiuying District, Haikou, the cost is 620 yuan per seat per day for less than 15 days and 580 yuan per seat per day for more than 16 days.
  2. Transportation and Installation Fee: Calculated separately based on the number of units, transportation distance, and installation complexity, with the calculation method clearly specified in the contract.
  3. Maintenance Fee:
    • In Wenzhou, basic maintenance is typically performed every 48 hours, with the maintenance frequency positively correlated with usage intensity; in Yiyang, cleaning service fees are charged 1-2 times per week.
  4. Consumables Fee: Items such as toilet paper, disinfectant, and deodorizer are usually additional items, and it can be agreed that the lessee will purchase them independently or that the lessor will provide them at cost.

3. Damage Compensation Mechanism

The liability and standards for equipment damage must be clearly defined, for example:

  • Natural wear and tear are borne by the lessor, while human-caused damage (e.g., dumping construction waste into the toilet) is compensated by the lessee based on the actual repair cost.
  • The compensation standards can refer to market repair prices or be determined through negotiation between the two parties. It is recommended to attach an equipment list and repair quotation sheet to the contract.

4. Rights and Obligations of Both Parties

  1. Obligations of the Lessor:
    • Responsible for equipment transportation, installation, and subsequent maintenance, such as specifying fault response times (e.g., arriving on-site within 2 hours) and cleaning frequency standards in Wenzhou; providing 24-hour maintenance response and non-stop rental services during holidays in Yiyang.
    • Ensure that the equipment meets safety standards, such as giving priority to contacting enterprises with the "Urban Domestic Waste Operational Cleaning, Collection, and Transportation Service License" in Nanping.
  2. Obligations of the Lessee:
    • Use the equipment reasonably, avoiding overloading or违规操作 (e.g., the construction party in Nanping is prohibited from dumping construction waste).
    • Cooperate with the lessor in regular maintenance, such as providing equipment usage records or assisting with cleaning.

5. Regional Special Provisions

  1. Wenzhou: The contract must consider moisture-proof and corrosion-resistant requirements, with equipment selection requiring moisture-proof performance (e.g., special treatment of circuit systems and metal components), and equipment fixation plans must be formulated during typhoon season.
  2. Yiyang: When signing the contract, all cost details must be clearly defined to avoid additional charges after low-cost rentals; confirm the lessor's qualifications and service capabilities (e.g., customized solutions).
  3. Nanping: During delivery and acceptance, check whether the toilet's appearance, internal facilities, and accessories (e.g., sewage pipes and water inlet pipes) are complete to ensure that the service scope is consistent with the contract.
