Prefabricated House Lease Contract Template

Admin September 18, 2026

The prefabricated house lease contract template should include the following core clauses, with details as follows:

I. Contract Subject Information
The names/designations, ID numbers/unified social credit codes, and contact details of the lessor (Party A), lessee (Party B) must be clearly specified. If a property management agent (Party C) is involved, their name, address, and contact information should also be supplemented. This clause ensures clear identification of contract parties and avoids disputes arising from unclear subjects.

II. Basic House Information

  1. House Details: The address, layout, and area of the house should be recorded in detail, with a note stating that 'the rent will not be adjusted if there is an error between the actual area and the area recorded in the contract'.
  2. Usage Restrictions: The purpose of the house (e.g., residential, commercial operation) should be clearly defined. Any change in purpose by Party B requires a written application and approval from Party A.
  3. Property Rights Guarantee: Party A must ensure that there are no disputes over the property rights of the house and complete debt settlement procedures such as mortgages before delivery. This clause protects Party B's usage rights and avoids contract invalidity due to property rights issues.

III. Lease Term and Delivery

  1. Term Agreement: The lease term must be agreed upon in writing. Any part exceeding 6 months must be in written form; any part exceeding 20 years is invalid.
  2. Delivery Time: Party A should deliver the house within X days after the contract takes effect, and Party B needs to inspect and confirm that the equipment and facilities are functioning properly.
  3. Rent-Free Period: A rent-free renovation period (e.g., 0 months) can be agreed upon, with clear start and end dates. This clause regulates the scope of the lease term and avoids disputes arising from oral agreements.

IV. Rent and Expenses

  1. Rent Standard: The rent amount, payment cycle (e.g., monthly payment), and late payment penalty (e.g., one-tenth of a percent per day) should be clearly specified.
  2. Adjustment Rules: Party A needs to notify Party B 2 months in advance of any rent adjustments and ensure Party B's priority right to renew the lease.
  3. Deposit: Usually equivalent to 3 months' rent, it will be refunded (without interest) upon contract expiration if there is no breach.
  4. Other Expenses: Expenses such as water, electricity, gas, and heating are borne by Party B, and any newly imposed government fees are also paid by Party B. This clause clarifies the division of expenses and avoids later disputes.

V. House Maintenance and Renovation

  1. Maintenance Responsibilities: Party A is responsible for regular inspections and major repair costs, while Party B bears the daily maintenance costs; losses caused by Party B's poor management are the responsibility of Party B.
  2. Renovation Restrictions: Party B's renovations require written approval from Party A. Upon lease termination, the house must be restored to its original condition or restoration costs paid.
  3. Structural Protection: Party B must not damage the house structure, comply with fire prevention and safety regulations, and accept supervision from Party A. This clause safeguards the house's safety and long-term usability.

VI. Dispute Resolution and Effective Conditions
If the parties cannot reach an agreement through consultation, they may file a lawsuit with the people's court at the location of the house. Within 2 days after the contract takes effect, an application for registration and filing must be submitted to the housing management department. This clause provides a clear path for dispute resolution and complies with regulatory requirements.

Notes: The contract should be adjusted according to actual needs. It is recommended to have it reviewed by a legal professional before signing to ensure the legality and validity of the clauses.
