Prefabricated House Lease Contract

Admin September 18, 2026

The prefabricated house lease contract should include the following core clauses, with specific content adjustable according to actual circumstances:

I. Contract Parties and House Information
The contract must clearly specify the identity information of the lessor (Party A) and the lessee (Party B), and provide a detailed description of the house's basic information, including specific address, layout (rooms/living rooms/bathrooms), and total area (square meters). For example: Party A's house is located at No. XX Road, XX District, XX City, with a layout of 3 rooms, 2 living rooms, and 1 bathroom, and a total area of approximately 100 square meters. This clause serves as the foundation of the contract and must ensure accurate information.

II. Lease Term and Purpose
The lease term must clearly specify the start and end dates, for example, from January 1, 2024, to December 31, 2025. The house is designated for residential use only, and Party B must not change the purpose without authorization, such as for commercial or storage purposes; otherwise, Party A has the right to terminate the contract.

III. Rent and Payment Method
The rent must clearly specify the monthly rent amount (in RMB), for example, 5,000 yuan per month. Rent adjustments must comply with agreed conditions:

  • When national policies change, follow the new regulations;
  • When market conditions or prices rise, Party A must notify Party B 2 months in advance, and Party B has the right of first refusal to renew the lease.
Party B must pay a deposit (e.g., one month's rent) on the contract's effective date, followed by monthly settlements, and pay to Party A's designated account by the 5th day of each month.

IV. House Delivery and Property Rights Commitment
Party A must deliver the house within X days (e.g., 7 days) after the contract's effective date and ensure there are no property rights disputes, including mortgages, liens, or taxes. If any unresolved issues arise after delivery, Party A must assume full responsibility and compensate Party B for losses.

V. Maintenance and Safety Responsibilities

  • Party A's Responsibilities: Bear the costs of major house repairs (e.g., structural maintenance) and conduct regular inspections and maintenance.
  • Party B's Responsibilities: Bear the costs of daily maintenance (e.g., replacing light bulbs, unclogging drains), and be responsible for losses caused by poor management. Party B must comply with fire safety regulations, the 'three responsibilities at the doorstep' policy, and accept Party A's supervision and inspections.

VI. Renovation and Structural Changes
If Party B needs to change the house's structure or renovate, they must obtain written consent from Party A. Upon lease termination, the house must be restored to its original condition or Party B must pay restoration costs. For example, if Party B removes a wall, they must provide a signed consent form from Party A; otherwise, they must bear the restoration costs.

VII. Expense Allocation
During the lease term, Party B must pay for water, electricity, gas, heating, and other expenses, and bear liability for late payments. If the government imposes unlisted fees (e.g., garbage disposal fees), Party B must also bear those costs.

VIII. Contract Termination and Renewal
Upon lease expiration, Party B has the right of first refusal to renew the lease, and Party A must prioritize renewing the contract under the same conditions. If Party B defaults on rent for more than 2 months, changes the purpose without authorization, or engages in illegal activities, Party A may terminate the contract and seek compensation.

IX. Other Clauses
The contract may include supplementary clauses on dispute resolution methods (e.g., litigation or arbitration) and force majeure handling. It is advisable to consult legal professionals before signing to ensure the clauses are legally compliant.
