Illegal Construction of Prefabricated Houses

Admin September 17, 2026

Illegal construction of prefabricated houses generally refers to the construction of houses and facilities without obtaining relevant permits such as the planned construction project permit, either outside the planned area or in violation of relevant laws and regulations.

Basis for Determining Illegal Construction

Whether a prefabricated house is considered illegal construction depends on whether it has legal construction permits. According to regulations, for house construction within the planned area, relevant approval documents such as the planned construction project permit must be obtained. If construction is carried out without obtaining these permits outside the planned area, or even within the planned area but in violation of relevant laws and regulations, the prefabricated houses built will be identified as illegal constructions. For example, more than 12 illegally built cement prefabricated storefronts on the east side of the resettlement community in Huaiya Community, Shuangwang Sub-district Office, Linwei District, Weinan City, and on the east side of the north section of Jiefang Road were identified as illegal constructions due to the lack of relevant legal permits.

Handling Methods for Illegal Construction

For identified cases of illegal construction of prefabricated houses, relevant departments will take a series of measures for handling. After the urban management law enforcement department discovers illegal construction during early inspections, it will contact and interview the parties on-site, explaining the illegality of the illegal construction and the possible consequences. At the same time, it will issue a "Notice of Order for Rectification" to the parties, requiring them to provide relevant construction permits. If the parties are unable to provide legal permits, relevant departments will continue to monitor and follow up, urging them to demolish the illegally constructed houses to ensure the lawful and compliant use of the site.

Differentiation from House Condition-Related Situations

It should be noted that the dilapidated prefabricated panel houses in cities mentioned in the relevant notices from the Ministry of Housing and Urban-Rural Development are included in the scope of demolition and reconstruction, which is different from the concept of illegal construction. The focus here is on the short service life and poor quality of the houses themselves, which seriously affect the quality of life of residents and the image of the city. The demolition and reconstruction are carried out based on the needs of urban renewal, rather than being identified as illegal constructions due to the lack of legal construction permits.
