Prefabricated House Demolition Compensation
Not all prefabricated building demolitions are eligible for compensation; only those identified as dilapidated houses or included in urban demolition plans qualify. The specific compensation methods and precautions are as follows:

I. Compensation Methods
Monetary Compensation
The government pays compensation through bank transfers, with the amount calculated comprehensively by professional appraisal agencies, including the market value of the house (referencing the prices of surrounding second-hand houses), decoration costs, moving expenses, rental subsidies during the transition period, and rewards for signing contracts on time. The appraisal price must not be lower than the market price of similar second-hand houses in the surrounding area and must consider the depreciation factor of the house. All compensation terms must be written into the contract in writing to avoid verbal promises.Property Rights Exchange
This is divided into two forms:
- Original-site Relocation: New houses are rebuilt on the original site, and the demolition victims exchange the area of new houses according to a predetermined ratio.
- Off-site Resettlement: The demolition victims are resettled in other areas. The contract must specify the specific building number, address, floor area, house type, and delivery date of the resettlement housing, as well as agree on the proportion of shared areas (to avoid excessive proportions) and the compensation standards for delayed delivery (such as paying a daily penalty of a certain percentage of the total house price).
- Housing Voucher Resettlement
A new method piloted in some regions in recent years, where demolition victims use government-issued 'housing vouchers' to purchase commercial housing in designated areas. The specific rules vary by region and must be based on local policies.
II. Key Precautions
- Risk Avoidance for Monetary Compensation
- Require the appraisal agency to present transaction data for surrounding second-hand houses to ensure a reasonable compensation price.
- The contract must include a clause stating that 'the appraisal price is not lower than the market price' and agree on dispute resolution methods (such as applying for a review or judicial appraisal).
- Risk Avoidance for Property Rights Exchange
- Verify the property rights nature of the resettlement housing (such as whether it has full property rights and whether there are any mortgages or seizures).
- Require the developer to provide the 'Construction Project Planning Permit' and a construction schedule to reduce the risk of delays.
- Clearly define the calculation method for shared areas (such as following the national standard GB/T 50353-2013) to avoid an excessively low actual housing acquisition rate.
- General Principles
- Reject any verbal promises not written into the contract. All compensation standards, payment methods, and liability for breach of contract must be confirmed in black and white.
- Consult a lawyer or professional institution before signing the contract to ensure there are no loopholes in the contract terms.
If the house is not identified as a dilapidated house and is not included in the demolition plan, it will not be eligible for compensation. Normal channels must be used to maintain housing safety (such as applying for a dilapidated house appraisal or participating in urban renewal plans).
