Prefabricated House Contract Template

Admin September 19, 2026

Currently, there is no specific contract template for prefabricated house construction projects. However, general building construction contract templates can be adjusted according to actual circumstances for use in prefabricated house projects. Below are descriptions of different models and general clauses:

Contracting with Labor and Materials

  • Contracting Method: Party B undertakes the project on a labor and materials basis, responsible not only for construction but also for material procurement. This means Party B must purchase, transport, and store all materials required for the project, ensuring material quality meets project requirements.
  • Project Duration: Clearly specify the start and completion dates, along with conditions for extending the project duration. For example, delays caused by Party A, such as failure to provide the construction site on time or design changes, or delays due to force majeure, such as natural disasters or government actions, should result in corresponding extensions of the project duration.
  • Project Cost: Pricing can be based on the actual building area or a total price. Payments are typically made in stages, such as a down payment after contract signing, progress payments based on construction progress during the project, and the final payment after project completion and acceptance.
  • Quality Acceptance: Party B must strictly follow national regulations for construction, and Party A organizes the acceptance. If quality issues arise, Party B shall repair them free of charge until they meet acceptance standards.
  • Safety Responsibility: Party B is responsible for safety management at the construction site. In case of safety accidents, Party B bears the responsibility.

Contracting with Labor Only

  • Contracting Method: Party A provides all materials required for the project, and Party B is responsible for providing and using construction equipment and tools.
  • Contract Funds: Generally, costs are calculated based on the building area, and prices for auxiliary buildings can be negotiated separately.
  • Payment Method: After project acceptance, Party A pays the full project amount in one lump sum.
  • Material Supply: Party A must ensure an adequate supply of materials. If project progress is affected due to delays in material supply by Party A, Party A bears the responsibility.
  • Safety Responsibility: Party B is responsible for safety during construction. If damage is caused to third parties, Party B shall compensate.

General Clauses

  • Responsibilities of Both Parties: Party A must pay project funds on time and provide necessary infrastructure for construction; Party B must construct according to regulations, ensuring project quality and construction safety.
  • Project Changes: If project changes are required, written notice must be given to the other party, and a supplementary agreement signed. Project costs shall be adjusted according to the principle of fairness.
  • Dispute Resolution: In case of disputes during contract performance, both parties shall first negotiate for resolution. If negotiation fails, they may file a lawsuit in court.
  • Contract Effectiveness: The contract takes effect from the date of signature and seal by both parties. It is made in duplicate, with each party holding one copy.

Notes: When using in practice, technical specifications, delivery standards, and other clauses should be supplemented according to the characteristics of prefabricated houses, and it is recommended to have them reviewed by legal professionals.
