Placing Containers on Houses

Admin September 15, 2026

Whether placing containers on houses constitutes illegal construction depends on the situation and cannot be generalized.

Situations where it usually does not constitute illegal construction

  • Temporary storage purposes: If containers are placed on the rooftops of self-built houses or in fields mainly for the temporary storage of agricultural materials and tools, similar to guard houses in farmlands and orchards, and there is no damage to the plow layer, no water or electricity supply inside, no traditional infrastructure construction on the ground, and no occupation of land quotas, containers are usually regarded as containers or temporary warehouses rather than houses and generally do not constitute illegal construction. For example, when Farmer Lao Wang placed a container house by his field to store farming tools, the urban management department verified and determined that it was not illegal construction.
  • Compliance with local policies: In some places, container houses are regarded as temporary buildings, and no construction permit is required for their erection and removal.

Situations where it usually constitutes illegal construction

  • Changing land nature and use: If the ground is hardened, permanent foundations are built, or containers are used for business operations or living, which is recognized as a 'substantial change in land use', it constitutes illegal construction. For example, using containers for homestay operations without going through relevant approval procedures may face the risk of demolition.
  • Failure to obtain planning permission: According to the 'Urban and Rural Planning Law of the People's Republic of China' and the 'Land Administration Law', any unit or individual engaging in construction must obtain planning permission and land use permission in accordance with the law. Placing containers in a planned area without obtaining a construction project planning permit constitutes illegal construction. For instance, when an owner in a residential community in Dongguan placed a container on the second-floor platform, the urban management department determined it to be illegal construction and ordered its removal due to the lack of relevant permits.

Suggestions

Due to differences in policies across regions, if there is a need to place container houses, it is advisable to first consult with local relevant departments clearly, go through the procedures according to the process, and clarify the usage period and purpose to ensure legality and compliance.
