Tax Policy for Mobile Toilets

Admin September 27, 2026

The tax policy for mobile toilets covers several aspects, including property tax, value-added tax (VAT), personal income tax, and corporate income tax, as detailed below:

Property Tax:
Whether mobile toilets are subject to property tax depends on whether they are classified as buildings and their intended use. According to regulations, a building must have a roof and enclosing structures and be used for production or work purposes. If a mobile toilet is designed to be movable and non-permanent, and not permanently fixed to a location, it may not be considered a building and thus not subject to property tax. However, if it has a roof and enclosing structures and is used permanently, it may be classified as a building. If located in cities, counties, towns, or industrial and mining areas, and used for commercial purposes (such as charging for use), property tax must be paid based on rental income or the original value of the property, with rates of 12% or 1.2% (depending on local regulations). Non-commercial uses (such as public facilities) are generally exempt. Mobile toilets in rural areas are generally not subject to property tax as they fall outside the scope of property tax collection.

Value-Added Tax (VAT):
Operating the rental of mobile toilets falls under the provision of tangible movable property rental services, with a general VAT rate of 13%. If the taxpayer is a small-scale taxpayer, a 5% levy rate applies (except for tax incentives). For example, if a company rents out mobile toilets to other units or individuals, it must pay VAT at this rate.

Personal Income Tax:
If an individual earns business income from renting out mobile toilets (such as rental income), they must pay personal income tax in accordance with the "Individual Income Tax Law of the People's Republic of China," applying a progressive tax rate ranging from 5% to 35%. The specific tax rate is determined based on the taxable income, with higher incomes subject to higher tax rates.

Corporate Income Tax:
If a mobile toilet project falls under the environmental protection projects specified in the "Catalogue of Corporate Income Tax Incentives for Environmental Protection, Energy Conservation, and Water Conservation Projects (2021 Edition)" (such as public waste disposal), the company may enjoy tax incentives: exemption from corporate income tax for the first three years from the纳税年度 (tax year) in which the project generates its first business income, followed by a 50% reduction for the next three years. For example, if a company invests in and operates mobile toilets for public waste disposal and meets the catalogue conditions, it can apply for this incentive.
