Mobile Toilet Taken onto Highway

Admin October 09, 2026

Taking a mobile toilet onto the highway is an illegal act, and the driver of the transport vehicle needs to bear legal responsibility. There are also management loopholes on the part of the management, and many problems exist in the industry.

Legal Responsibility Aspect

According to Article 55 of the Regulations on the Implementation of the Road Traffic Safety Law, the cargo compartment of a freight vehicle shall not carry passengers. In this incident, the driver of the transport vehicle started the vehicle without checking the condition of the cargo compartment and took a mobile toilet with a woman inside onto the highway. Regardless of whether the driver knew there was a person inside the mobile toilet, they are responsible for the loading condition of the vehicle and must bear legal responsibility. They may face a penalty of six demerit points and a fine ranging from 500 yuan to 2,000 yuan.

Management Responsibility Aspect

The management of the mobile toilet has serious management loopholes and has failed to fulfill its safety guarantee obligations. If a woman encounters an accident in the mobile toilet, she can request the management to compensate for reasonable expenses such as transportation costs, lost work wages, and mental distress damages. The management is responsible for ensuring the safe use of the mobile toilet, including checking the condition of the toilet before transportation to avoid such dangerous situations.

Industry Problem Aspect

This incident exposes the chronic problem of 'emphasizing transportation over inspection' in the mobile toilet industry. Among more than 100,000 mobile toilet dispatches across the country each year, only 37% of drivers carry out a complete inspection process, which significantly increases the probability of accidents. In addition, some mobile toilet product manuals do not include warning clauses such as 'Do not lock the door when using the toilet,' making it difficult for users to rescue themselves in case of danger. Moreover, there are design flaws in mobile toilets. Their sound insulation performance generally reaches 35 decibels, which can block highway noise but also locks in cries for help, making it difficult for trapped people to send effective distress signals to the outside world.
