Mobile Toilet on Rooftop
Placing a mobile toilet on the rooftop may involve illegal construction issues, and setting it up without approval is an illegal act.

I. Analysis of Illegality
According to Article 40, Paragraph 1 of the Urban and Rural Planning Law of the People's Republic of China, any unit or individual undertaking the construction of buildings or structures must apply for a construction project planning permit in accordance with the law. A case handled by the Comprehensive Administrative Law Enforcement Team in Shanyang Town, Jinshan District on August 20, 2026, showed that a resident in a certain residential community illegally installed a mobile toilet on the rooftop terrace and was identified as illegal construction due to the lack of approval procedures. Such behavior directly violates the mandatory requirements of the Urban and Rural Planning Law. Even if the facility itself is mobile, as long as it is fixed on the rooftop and forms a long-term occupation state, it constitutes an illegal act.
II. Safety Risks
- Structural Safety: The design load-bearing capacity of rooftops usually only meets the original functional requirements of equipment layers or lightning protection facilities. The weight of a mobile toilet (including the sewage storage device) may exceed the design load of the rooftop, and long-term use can easily lead to structural deformation or even collapse.
- Falling Objects from Heights: If the fixing method of the mobile toilet does not comply with building codes (e.g., only using expansion bolts for fixation), it may detach under strong winds or vibrations, posing a threat to people and property below.
- Occupation of Public Resources: The rooftop belongs to the common space of all property owners. Setting up a mobile toilet privately deprives other owners of their reasonable right to use it and may lead to neighborhood disputes.
III. Conditions for Compliant Installation
If there is a special need (such as temporary construction or large-scale events) to install a mobile toilet on the rooftop, the following conditions must be met:
- Approval Procedures: Submit an application for a construction project planning permit to the local planning department, providing materials such as a structural safety assessment report and a construction plan.
- Safety Specifications: Commission a professional institution to review the load-bearing capacity of the rooftop to ensure that the weight of the facility does not exceed 80% of the design load; use high-strength fixing methods such as chemical anchors and install wind-resistant guy wires.
- Usage Period: Clearly define the temporary usage period (generally not exceeding 6 months), and the facility must be immediately removed and the rooftop restored to its original state upon expiration.
IV. Suggestions for Applicable Scenarios
The original design intention of mobile toilets is to meet temporary and mobile needs, and their typical application scenarios include open spaces such as stations, docks, and tourist attractions. When used in residential areas, priority should be given to selecting open ground spaces and ensuring compliance with requirements for fire exits and green space protection.
