Long-term Rental Contract for Mobile Toilets

Admin October 10, 2026

The long-term rental contract for mobile toilets should include the following key elements:

I. Contract Parties and Rental Subject The contract should clearly specify the full names of Party A (lessor) and Party B (lessee), and agree on the quantity and model of mobile toilets to be rented (subject to the model confirmed in writing by Party B). For example, it can state, 'Party A rents to Party B X mobile toilets of model Y,' ensuring specificity of the subject matter.

II. Rental Term and Renewal Rules The rental term should clearly specify the start and end dates (e.g., 'from [date] to [date]'). If Party B wishes to renew the lease, it must submit a written application 3 months before the expiration of the term, and Party A must respond within 15 working days. This clause helps avoid disputes arising from ambiguous terms.

III. Rent and Payment Method

  1. Rent Calculation: Agree on the daily rent per unit (e.g., X yuan per unit per day) and the total annual rent (e.g., Y yuan payable annually).
  2. Payment Time: Party B should pay the rent for the next year one month before the expiration of each year to avoid overdue payments.
  3. Payment Method: Specify bank transfer or cash payment, and require Party A to issue formal invoices to ensure financial compliance.

IV. Rights and Obligations of Both Parties

  1. Obligations of Party A:
    • Provide mobile toilets of acceptable quality to meet normal usage needs.
    • Be responsible for routine maintenance, upkeep, and repair of faults, with costs borne by Party A.
    • Have the right to reclaim the equipment upon expiration of the rental term or termination of the contract.
  2. Obligations of Party B:
    • Pay the rent on time without delay.
    • Take good care of the equipment and refrain from unauthorized alterations or damage; otherwise, compensation is required.
    • Return the equipment in good condition upon expiration or termination of the rental term.

V. Liability for Breach of Contract

  1. Breach by Party A: If Party A fails to provide the equipment on time or maintain it properly, resulting in Party B's inability to use it, Party A shall bear liability for breach (e.g., rent reduction or compensation for losses).
  2. Breach by Party B: If Party B delays rent payment or damages the equipment, it shall pay a penalty or compensate for actual losses.

VI. Termination and Dissolution of Contract

  1. Termination Conditions: The contract terminates automatically upon expiration, or Party B may terminate it by giving 6 months' written notice to Party A and obtaining consent.
  2. Dissolution Conditions: Both parties may agree to dissolve the contract, and Party B must return the equipment and restore it to its original condition (e.g., remove any additional installations).

VII. Dispute Resolution Agree on friendly negotiation as the method for resolving disputes; if negotiation fails, litigation shall be initiated in the court at Party A's location, clarifying judicial jurisdiction.

VIII. Other Clauses

  1. If Party B wishes to modify the equipment, it must obtain prior consent from Party A and restore it to its original condition upon expiration of the term.
  2. The contract takes effect upon signature and sealing by both parties and is made in duplicate, with each party holding one copy.
