Incident Details
On August 29, 2020, a man named Jiang, who manufactured mobile toilets, reported to the Hefei Public Security Bureau that one of his new mobile toilets, which he had placed near Longgang Road for sale, had been stolen. The mobile toilet was worth over 5,000 yuan and had a selling price of 8,000 yuan. Through surveillance footage, the police discovered that on the night of August 28, several individuals drove a tricycle to steal the toilet and moved it to a residential area several kilometers away. Around 5 p.m. on September 1, the stolen toilet, covered with a white woven bag, was found behind a supermarket. Investigation revealed that it had been stolen by Ms. Xia, a 63-year-old woman living next to the supermarket owner.
Reason for Theft
Ms. Xia claimed that due to the large number of people in her family, her mother-in-law had difficulty using the toilet and took a long time, which affected others. While taking a walk, she noticed the toilet and, on the night of August 29, conspired with two others to move it away.
Legal Classification
Ms. Xia has been charged with theft because she stole a mobile toilet that was prepared for sale by another person. According to the market retail price in the circulation sector, the toilet should be valued at 8,000 yuan for the purpose of determining the crime. According to relevant laws, those who steal public or private property with a relatively large value, or commit multiple thefts, burglaries, thefts with dangerous weapons, or pickpocketing, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, or public surveillance, and shall also, or shall only, be fined. Therefore, Ms. Xia may face up to three years in prison, and the two individuals who participated in the theft with her will be punished as accomplices in a joint crime.
This incident serves as a reminder that no matter the reason, one should not obtain others' property through illegal means, as they will face legal sanctions.
