Background of Legacy Issues
In 2018, Hangzhou Yuanzhu Technology Co., Ltd. produced and installed the container commercial street beside Miluo River Avenue in Guiyi Street for Jincheng Group's Shanyuan Market, but the final payment for the project was not settled. In 2019, Jincheng Group was involved in a case, and its key executives and legal representatives were arrested and sentenced. The company then filed a lawsuit, but due to the unresolved criminal case of Jincheng Group, the court did not accept civil cases from 2019 to 2022. In April 2023, the case was filed and adjudicated, and the plaintiff, Hangzhou Yuanzhu Technology Co., Ltd., was granted priority compensation rights within the scope of the project payment of 1,434,427.85 yuan for the discounted or auctioned proceeds of the project involved. However, the judgment has not been executed to date.
On-site Conditions and Management Disputes
The containers on-site have been stolen and damaged, posing safety hazards. The court replied that the container commercial street has been classified as an illegal structure and cannot initiate the auction process. The park management office obstructs the removal on the grounds that the company has no right to dispose of the containers, and there is usually no one to watch over them, allowing the containers to be damaged and stolen without taking responsibility for supervision. The police station refuses to accept reports of theft on the grounds that the company is not the owner of the containers. The urban management does not provide a management basis and only roughly states, 'Without notification from a leader, we won't release them.' There are still local scrap recycling station personnel taking advantage of the situation to steal without being stopped, and the matter is stuck in a state of mutual shirking of responsibility among various parties.
Demands and Responses
Hangzhou Yuanzhu Technology Co., Ltd. proposed the demands of debt settlement through asset transfer and direct removal for cash conversion, with the process notarized by a notary office. On June 23, 2026, the Miluo City Urban Management and Comprehensive Law Enforcement Bureau responded that, after investigation, the management of this area still belongs to Jincheng Group and not to their unit. Regarding the removal issue, they only recognize court judgments and will not obstruct if there is a court judgment.
