Man Steals Mobile Toilet

Admin September 24, 2026

A man named Jiang was fined 5,000 yuan for stealing a mobile toilet.

Case Details

During the Jintan Maoshan Mountain Half Marathon, mobile toilets were set up along the route to meet the needs of participants and spectators. Jiang, in his 50s, usually helps manage a fish pond. Due to frequent instances of people relieving themselves indiscriminately around the fish pond he oversees, he came up with the idea of taking a mobile toilet back to place beside the pond for public use. After the race, Jiang used an electric tricycle to transport away a mobile toilet worth 4,750 yuan. On the afternoon of the same day, there were no fishing guests at the pond. At around 6 p.m., he heard that someone was looking for the toilet and returned the stolen one, but by then, all the other mobile toilets had already been collected.

Legal Definition

Jiang's actions constituted the crime of theft. Theft refers to the act of stealing public or private property with the intent of illegal possession, where the value of the stolen property is relatively large, or there are multiple thefts, burglaries, thefts with dangerous weapons, or pickpocketing. Although Jiang's initial intention for stealing the mobile toilet was to address the issue of indiscriminate urination and defecation around the fish pond, which may seem somewhat 'reasonable,' this act, done without permission, unlawfully appropriated someone else's property and infringed upon the property rights of the victimized unit, meeting the elements of the crime of theft.

Sentencing Basis

After the incident, Jiang voluntarily surrendered and truthfully confessed his crimes, which constitutes the circumstance of voluntary surrender. According to the law, for criminal elements who voluntarily surrender, leniency or mitigation of punishment may be granted. At the same time, he actively cooperated with the public security organs in recovering and returning the stolen mobile toilet to the victimized unit, obtaining their forgiveness. These circumstances were taken into account during sentencing. Ultimately, the court, considering Jiang's criminal circumstances, repentance, and other factors, sentenced him to a fine of 5,000 yuan. This verdict not only reflects the seriousness of the law, punishing Jiang's illegal behavior, but also takes into account his mitigating circumstances, achieving an appropriate balance between crime, responsibility, and punishment.
