Is Placing Containers Near Houses Considered Illegal Construction?

Admin September 17, 2026

Whether placing containers near houses is considered illegal construction depends on the specific circumstances. Unauthorized house-like modifications or fixed use of containers generally constitute illegal construction.

Containers Modified for House-like Use Without Approval Are Illegal

If a container undergoes house-like modifications, such as being connected to water and electricity supplies, having doors and windows installed, or being equipped with air conditioning, enabling it to serve as a residence or for long-term use, and such modifications are not approved by the urban and rural planning authorities, then this action constitutes illegal construction. According to the Urban and Rural Planning Law of the People's Republic of China, any construction project, including the house-like modification and fixed use of containers, requires a construction project planning permit. Unauthorized placement of modified containers without this permit violates relevant laws and regulations and is considered illegal construction.

Time Limit for Temporary Buildings

Temporary buildings generally have a usage period of two years and must be demolished before expiration. If a container is used as a temporary building, even if initial approval was obtained, it must be removed within the specified usage period. Failure to remove it after the period expires will also result in it being classified as illegal construction.

Temporary Storage Without Modification May Not Involve Illegal Construction

If a container is only temporarily stored near a house as a transportation device, without undergoing any house-like modifications and without changing its original purpose as a transportation device, it may not involve illegal construction. However, it should be noted that such temporary storage should not affect the surrounding environment, traffic, or the normal lives of others.

Fixed Use or Change of Purpose Requires Legal Approval

If a container is fixed in a specific location for long-term use or its original purpose as a transportation device is changed, such as being converted into a warehouse or shop, it is necessary to apply for approval from the urban and rural planning authorities in accordance with the law. Only after obtaining relevant permits, such as a construction project planning permit, can the container be placed and used accordingly. Otherwise, it constitutes illegal construction.
