Is It Illegal to Place Containers Beside a House?
Admin September 17, 2026
Whether it is illegal to place containers beside a house depends on the specific circumstances and cannot be generalized.

Legal Situations
- As a temporary structure in compliance with regulations: According to Article 44 of the Urban and Rural Planning Law of the People's Republic of China, temporary construction within urban and town planning areas should be approved by the urban and county people's government urban and rural planning authorities. If the container house has obtained relevant approval and is demolished by itself within the approved usage period, it is not considered an illegal structure. For example, some construction sites place containers after obtaining approval for the temporary storage of construction materials or as temporary rest areas for workers, and demolish them within the specified time, which is a legal act.
- Used for permanent residence or commercial purposes with complete documents: If the container house is used for permanent residence or commercial purposes, and the builder has obtained relevant documents such as the construction land planning permit and the construction project planning permit in accordance with the regular construction procedures, such container houses are also not considered illegal structures. This means that, under the premise of complying with planning and construction requirements, container houses can legally exist and be used like ordinary buildings.
Illegal Situations
- Unauthorized construction without approval: According to Article 64 of the Urban and Rural Planning Law of the People's Republic of China, construction without obtaining a construction project planning permit or construction not in accordance with the provisions of the construction project planning permit is considered illegal construction. If a container house is privately built for residence or business activities without approval, it violates the relevant regulations on urban planning and construction management, and such container houses will be identified as illegal structures.
- Violation of land use regulations: According to Article 37 of the Land Administration Law of the People's Republic of China, non-agricultural construction must use land economically and must not擅自 (unauthorizedly) change the land use. If the construction of the container house violates the land use determined by the overall land use plan, such as unauthorized construction on agricultural land for non-agricultural purposes, it violates the relevant laws and regulations on land management, and such container houses will also be regarded as illegal structures.
- Unauthorized housing modification or stacking in public areas: Unauthorized modification and construction of containers to make them suitable for residence, such as connecting to water and electricity, opening doors and windows, or installing air conditioners, should be regarded as illegal structures; if containers are stacked in public areas, they should be identified as illegal occupation of public space.
