Is It Illegal for Mobile Homes Containers?
Whether mobile home containers are illegal needs to be discussed on a case-by-case basis. Generally, it is not illegal when used simply as a warehouse, but it may involve illegality when used for living or altering the vehicle structure.

Potential Illegality When Used for Living
- Defining Illegal Construction Conditions: Illegal construction must meet two conditions. First, it must be a building. Second, it must be constructed in violation of regulations without approval procedures. A container itself is just a movable metal component, not a traditional building. However, if used for living, it will be regarded as illegal construction in most areas. This is because the living purpose changes its original nature, and it often does not go through legal planning and construction approval processes.
- Special Circumstances: Some areas have filing requirements for residential containers. If used without filing, there may also be illegal risks. For example, in some urban villages or areas with strict planning and management in cities, placing residential containers for living without permission may be required to be removed or rectified by relevant departments.
Generally Not Illegal When Used as a Warehouse, but with Prerequisites
- Not Occupying Public Space: If the container is used as a warehouse and placed on self-owned land or land that has been legally leased and obtained usage rights, and does not occupy public open spaces while being recognized by the property management or other management departments, it is generally not considered illegal construction. For example, placing containers on the open space inside a factory as temporary warehouses for storing production materials.
- Occupying Public Space Without Approval: If the placement occupies public open spaces such as fire exits or public green spaces in residential areas and does not obtain the approval of the property management or other management departments, it is an illegal act. In this case, there is an obligation to correct. If it has been implemented, it should be suspended. Try to communicate and obtain the approval of the management department before continuing, or directly cancel the plan to avoid unnecessary losses.
Illegality of Trucks Carrying Container Houses
According to China's Road Traffic Safety Law, trucks carrying container houses are considered to have擅自改变机动车构造 (unauthorized alteration of the vehicle structure). For maintenance factories that unauthorizedly refit or assemble motor vehicles, they will be ordered to make corrections. If there are illegal gains, the illegal gains will be confiscated. If there are no illegal gains or the illegal gains are less than 10,000 yuan, a fine of not less than 20,000 yuan but not more than 50,000 yuan will be imposed, and parts and working tools will be confiscated. In serious cases, the business license will be revoked.
