How to Approve Container House
Container houses require approval as they fall within the category of buildings and need to be declared for approval when occupying public spaces or engaging in business relationships. The specific approval process and requirements are as follows:

I. Necessity of Approval
Although container houses are transformed from containers as the base material, they possess the characteristics of houses with windows and doors and occupy certain public spaces or engage in business transactions, thus being classified as buildings. According to Article 25 of the Urban Real Estate Administration Law of the People's Republic of China, real estate development must strictly adhere to urban planning, implementing comprehensive planning, rational layout, integrated development, and supporting construction. This means that any construction activities that occupy public spaces or alter land use properties must undergo planning approval.
II. Approval Process
- Prepare Materials: Prepare relevant materials such as land use certificates, planning permits, and architectural design drawings. If the land use nature is unclear, it is advisable to consult local government departments for specific requirements first.
- Submit Application: Submit an approval application to the local land and resources department or urban and rural planning authority, along with the relevant materials.
- Review and Approval: The relevant departments will review the application materials and assess whether the container house complies with urban planning, land use properties, and other requirements. If approved, a planning permit or temporary construction approval document will be issued.
III. Consequences of Non-Approval
If a container house is constructed without obtaining approval, the following consequences may arise:
- Classified as Illegal Construction: According to Article 32 of the Regulations on the Planning and Construction Management of Villages and Towns, temporary buildings, structures, and other facilities constructed without approval will be ordered to cease construction, be demolished within a specified time limit, or be confiscated.
- Invalid Contracts: If an unapproved container house is used for rental or other business activities, the relevant lease contracts may be deemed invalid due to violation of mandatory legal provisions.
- Legal Liability: Illegal construction activities may also face administrative penalties such as fines and even civil compensation liabilities.
