Home Rooftop Mobile Toilet
Setting up a mobile toilet on a home rooftop is an unauthorized construction activity without approval, which is suspected of being illegal and poses safety hazards, and should not be carried out.

Legal Aspect: Violation of Urban and Rural Planning Regulations
According to Article 40, Paragraph 1 of the Urban and Rural Planning Law of the People's Republic of China, for construction projects such as buildings and structures within urban and town planning areas, the construction unit or individual shall apply to the relevant department for a construction project planning permit. The rooftop terrace belongs to the public space of the residential community and is jointly owned by all property owners, rather than being a private exclusive area. Setting up a mobile toilet on the rooftop is a construction activity. If it has not undergone planning approval, it violates the above-mentioned legal provisions and constitutes illegal construction. The relevant department has the authority to order the cessation of construction, demand demolition within a specified time limit, and if not demolished voluntarily, it can be forcibly demolished in accordance with the law, and the party involved may be fined.
Safety Aspect: Risks of High-altitude Falling, etc.
Setting up a mobile toilet on the rooftop, if not constructed in a standardized manner, can bring serious safety hazards. For example, when the mobile toilet is located close to the edge of the terrace, under adverse weather conditions (such as strong winds or heavy rain) or due to human collision, the toilet facilities may topple or fall, causing damage to people and property below. Moreover, the rooftop is not designed to bear the weight of facilities such as toilets. Unauthorized construction may damage the structure and waterproof layer of the rooftop, affecting the overall safety and service life of the building, leading to problems such as rooftop leakage and causing losses to other property owners.
Actual Case Support
On August 20, 2026, the Shanyang Town Comprehensive Administrative Law Enforcement Team received a tip-off about suspected illegal construction on the rooftop of a residential building in its jurisdiction. After investigation, it was found that the resident had unauthorizedly built two aluminum alloy glass sunrooms on the rooftop terrace and illegally set up a mobile toilet. The mobile toilet was located close to the edge of the terrace, posing an obvious risk of high-altitude falling. Moreover, all the constructed facilities had not undergone any construction planning approval procedures, constituting illegal construction. This case fully illustrates the illegality and harmfulness of setting up a mobile toilet on the rooftop.
