Dongguan Container House Regulations
Whether containers are legal in Dongguan and the related rules are as follows:

I. Criteria for determining whether a container is a building In Dongguan, whether a container is recognized as a building hinges on whether it constitutes a relatively fixed place used for living or activities. If a container is placed on an outdoor platform, provides independent usable space, is fitted with basic house features such as doors and windows, has interior partitions, and contains belongings so that it becomes a place where people actually live or carry out activities, it should be classified as a building. This determination is based on functionality and permanence, not solely on material or form.
II. Requirements for applying for a construction project planning permit Under the Urban and Rural Planning Law of the People's Republic of China, a construction entity (including individuals) must apply to the competent authority for a construction project planning permit when undertaking construction work. If a container is installed without obtaining that permit and the container is deemed a building, the act constitutes construction without a construction project planning permit, and the container will be treated as an illegal structure. This rule is intended to regulate construction activity and ensure the unity and order of urban planning.
III. Exceptions: exemption from permitting Although installing a container generally requires a permit, small-scale renovations that fall within the Scope of Dongguan Construction Project Planning Permit Exemption Items may be exempt from permitting. This means that, when specific conditions are met (such as limited scale and no adverse impact on urban planning), a construction entity or individual may install and use a container without obtaining a construction project planning permit. This exemption policy aims to simplify the approval process and support flexible implementation of small and micro projects.
