Domestic Container House Application
Admin September 16, 2026
Whether a domestic container house requires application for construction depends on the specific circumstances. If it meets conditions such as temporary use, no alteration of land nature, and no involvement in business or residence, it may not require application or the approval process may be relatively simple. However, if it is used as a permanent structure or alters the land use, application must be made and relevant permits obtained; otherwise, it may be deemed illegal construction.

Cases Where Application May Not Be Required or Approval Is Relatively Simple
- Temporary Use Without Altering Land Nature: In some places, if container houses are used for temporary storage of agricultural supplies or tools, they are considered as guard houses for farmland or orchards. If they do not damage the plow layer, lack internal water and electricity connections, have no traditional foundation construction on the ground, and do not occupy land quotas, they are generally not considered illegal constructions and may not require application. For example, placing a container on one's own rooftop for temporary storage generally does not count as illegal construction.
- Compliance with Temporary Building Regulations: Some regions allow container houses to be used as temporary buildings, exempting them from planning permits for 1-2 years, but requiring self-demolition upon expiration. For instance, container resettlement sites built in Lankao, Henan, after rainstorm disasters were not deemed illegal constructions as they served emergency purposes and were registered.
Cases Where Application Is Mandatory
- Use as Permanent Structures: If container houses are used as permanent buildings, they must be included in rural construction planning. For example, a homestay cluster in Anji, Zhejiang, formed a double-story LOFT structure by horizontally splicing six containers. It became a legal commercial building after submitting a design plan to the township government in advance and obtaining approval.
- Alteration of Land Use or Use for Business or Residence: If used for residence or commercial purposes on rural homesteads, the land nature must be homestead or have undergone agricultural land conversion approval. For example, an agricultural company in Hainan was ordered to rectify and restore farmland to its original state for building container houses on permanent basic farmland. Container houses used for residence must also meet structural safety and fire protection requirements, using Class A fire-resistant materials and having a unit floor area not exceeding 300 square meters.
