Domestic Allowance for Container Houses
The construction of container houses is allowed in China, but specific conditions must be met and approval procedures must be followed. The detailed requirements are as follows:

Legal Basis and Land Use Requirements
According to the Land Administration Law of the People's Republic of China, the construction of container houses by rural villagers on legally acquired homesteads is generally considered legal, provided that it complies with the overall land use plans of townships (towns) and village plans. Permanent basic farmland must not be occupied, and preference should be given to using existing homesteads or vacant land within the village. If agricultural land is involved, approval procedures must be followed in accordance with the law. In urban areas, container houses used for temporary purposes (such as warehousing or storage of agricultural materials), without hardening the ground, connecting to water and electricity, or altering the land's nature, are generally not considered illegal constructions. However, if they are used for long-term residence, business operations, or altering the land's purpose, they must be declared and approved as formal buildings.
Approval and Compliance Requirements
Container houses fall within the scope of construction and require planning and construction permits from relevant departments. Key compliance conditions include:
- Structural Safety: They must comply with the Technical Specification for Modular Container Houses (CECS 334:2013) and the Technical Standard for Modular Buildings, ensuring that wind, earthquake, and fire resistance performance meet standards. For example, container houses used in engineering camps must have a wind resistance rating of at least 10 and an earthquake resistance rating that meets local seismic fortification standards.
- Usage Restrictions: Container houses used for temporary storage must avoid hardening the ground, connecting to water and electricity, or being converted into business premises; otherwise, they may be considered illegal constructions.
- Environmental Protection and Reusability: Products must meet a reusability rate of over 80% to reduce construction waste generation.
Special Scenarios and Regional Policy Differences
- Rural and Agricultural Land: Some major agricultural provinces require temporary building registration for container houses in fields, even if they are only used for storing agricultural tools.
- Urban Business Purposes: If used for homestays, shops, etc., land use approval, planning registration, and fire safety permits must be obtained. Priority should be given to commercial/cultural tourism land, avoiding farmland protection zones.
- Residential Use: Formal construction permits must be declared, with a height limit of no more than 6 floors and a total height of ≤24 meters.
Recommendation: Before construction, consult the local natural resources bureau or housing and construction department to clarify land nature, approval procedures, and usage periods to avoid the risk of demolition due to procedural violations.
