Does the Government Support Container Houses?

Admin September 16, 2026

The government has not explicitly and uniformly supported or prohibited container houses. Their legality depends on whether they comply with regulations regarding land use, planning, and approval.

Basis for Legality Determination

  • Land Nature and Homestead Regulations: Building container houses on legally acquired rural homesteads is generally considered legal. According to the Land Administration Law of the People's Republic of China, each rural household is entitled to only one homestead, which must conform to the overall land use plan of the township and village planning and must not occupy permanent basic farmland. For example, if a villager places a container house on their own homestead as a residence and does not exceed the homestead area standard while complying with the planning, it is usually legal.
  • Approval Procedures Requirements: If a container house has not been applied for through the relevant competent authorities or the approved application has not been implemented, and no land use right certificate or planning permit has been obtained, it constitutes an illegal building. According to the Urban and Rural Planning Law of the People's Republic of China, in areas covered by township and village planning, those who fail to obtain a rural construction planning permit in accordance with the law or fail to construct in accordance with the regulations shall be ordered by the township or town people's government to stop construction, make corrections within a time limit, and if corrections are not made within the time limit, the building may be demolished.

Special Circumstances and Risks

  • Public Land and Safety Hazards: If container houses are used for storage and occupy public land or have a negative impact on the surrounding environment and residents' lives (such as being dirty, disorderly, or posing safety hazards), urban management agencies may intervene and require relocation. For example, the Chongming Urban Management once carried out a special rectification of container houses that had been transformed into residential buildings in its jurisdiction due to their lack of safety guarantees and management, which could easily trigger environmental and safety issues.
  • Temporary Buildings and House Number Management: Although some container buildings hang temporary house numbers (such as container buildings in Pudong, Shanghai), the house numbers are only used for personnel information collection and have nothing to do with the legality of the buildings. After a temporary building is demolished, the house number will be automatically cancelled and does not involve real estate rights and interests.
