Container Truck House and Underground House

Admin September 17, 2026

Whether container houses can be placed underground depends on various factors, primarily the nature of the land, its intended use in planning, and whether legal approval has been obtained.

I. Impact of Land Nature

  • Agricultural Land: According to Article 2 of the Land Administration Law of the People's Republic of China, agricultural land is strictly protected and its use cannot be altered without authorization. If a container house is placed underground and involves agricultural land, altering the land use without going through the statutory approval process is illegal.
  • Construction Land: For construction land such as homesteads and collectively-operated construction land, in theory, container houses can be placed underground if they comply with relevant plans and regulations and have undergone legal approval. However, it is important to note that even if the land is designated for construction, placing containers underground must not violate urban and rural planning, fire safety, and other relevant regulations.

II. Planning Approval Requirements

  • According to Article 40 of the Urban and Rural Planning Law of the People's Republic of China, for construction projects such as buildings and structures within urban and town planning areas, a construction project planning permit must be applied for. Even if container houses are movable, if they are placed underground and form part of a building or structure, legal approval is required. During the approval process, relevant documents proving land use, construction project design plans, and other materials must be submitted, and compliance with regulatory detailed plans and planning conditions must be ensured. If placing containers underground violates planning conditions, such as affecting underground pipelines or fire exits, planning permission cannot be obtained.

III. Temporary Use Situations

  • If container houses are used temporarily, such as for emergency shelters or temporary storage, and comply with temporary land use regulations, a construction project planning permit may not be required. However, it is important to note that temporary use also has a time limit, and upon expiration, the containers must be removed or renewal procedures must be completed. The use of underground space must comply with relevant laws and regulations such as the Urban and Rural Planning Law of the People's Republic of China to ensure that underground pipelines are not damaged and geological safety is not affected. If placing containers underground involves underground space development, special approval and planning are required.

IV. Practical Case References

  • There are cases where containers have been used to build underground houses, such as when special terrain conditions arise or when homeowners have specific needs, and basements are chosen as the construction structure.
