Do Container Houses Need to Pay Taxes?

Admin September 16, 2026

Generally, container houses do not need to pay real estate tax, but they must meet specific conditions and may involve other approvals and taxes. Details are as follows:

Reasons for not needing to pay real estate tax

  • Not classified as real estate: Containers are defined as containers for transporting goods, primarily for transportation purposes, and do not inherently belong to real estate. Even if they are transformed into places for people to work or study, since they do not have property rights, according to Article 2 of the 'Provisional Regulations on Real Estate Tax,' real estate tax is paid by the property owner. Therefore, they do not fall under the category of real estate tax payers and should not pay real estate tax.
  • Legal basis: The 'Explanation and Regulations on Several Business Issues Concerning Real Estate Tax and Vehicle and Vessel Usage Tax' (Caishuidizi [1987] No. 3) defines 'real estate' as 'property manifested in the form of a house. A house refers to a place with a roof and enclosing structures (with walls or pillars on both sides) that can shelter from wind and rain and where people can engage in production, work, study, entertainment, residence, or store goods.' Container houses do not meet this definition.

Other possible situations

  • Approval requirements: Container houses are a type of movable prefabricated house. If their construction occupies public spaces or involves business transactions, they fall under the category of buildings and require approval. For example, they are commonly used as workers' dormitories on construction sites or as rental housing, both of which require approval in accordance with relevant regulations.
  • Other taxes and fees: Although real estate tax is generally not required, in certain regions or under specific circumstances, other taxes and fees, such as local taxes, may be involved. For example, in France, some container houses do not require real estate tax; however, there are also special cases, such as a 'container yacht' that does not require real estate tax, which may be related to its special usage scenario and local policies.
