Container House Rental Tax Rate

Admin September 15, 2026

The value-added tax (VAT) rate for container house rentals is generally 5%, but the specific applicable policy depends on the taxpayer's identity and business type. The following analysis covers three aspects: tax rate applicability, preferential policies, and special circumstances.

I. Basic Tax Rate Applicability
According to current VAT policies, the VAT collection rate for small-scale taxpayers renting out container houses (classified as real estate rental services) is 5%. This rate applies uniformly to individuals or enterprises conducting rental business as small-scale taxpayers, regardless of the rental purpose (e.g., construction site dormitories, temporary offices). For example, if an enterprise rents out container houses as a small-scale taxpayer with a monthly rental income of 100,000 yuan, it needs to calculate and pay 5,000 yuan in VAT at a 5% rate.

II. Preferential Policies and Restrictions

  1. Exemption Policy: From April 1 to December 31, 2022, small-scale taxpayers issuing regular VAT invoices are eligible for a VAT exemption without monthly or quarterly exemption thresholds of 150,000 yuan or 450,000 yuan, respectively. However, it is important to note that the tax rate column on the invoice must be selected as 'tax-exempt' rather than '0%', otherwise the exemption cannot be enjoyed.
  2. Special Invoice Restrictions: If a small-scale taxpayer issues a special VAT invoice, they must pay VAT at a 3% rate and are not eligible for the exemption policy. For example, if an enterprise issues a special invoice to a customer for rental income of 100,000 yuan, it needs to pay 3,000 yuan in VAT.
  3. Real Estate Rental Exception: For real estate rental services (such as container house rentals), if the collection rate is 5%, the above VAT exemption policy does not apply. Even if a regular invoice is issued, VAT must still be paid at a 5% rate.

III. Special Circumstances and Considerations

  1. General Taxpayer Rate: If a taxpayer is forced to upgrade to a general taxpayer (e.g., if the invoice amount exceeds 5 million yuan for 12 consecutive months), they must pay VAT using the general tax calculation method, with a rate typically of 9% (the VAT rate for real estate rental services), and can deduct input tax credits.
  2. Income Tax Obligations: VAT exemptions do not affect income tax payments. If a small-scale taxpayer meets the conditions of a small and low-profit enterprise, the income tax rate is 5% for the portion of annual taxable income between 1 million and 3 million yuan, and 2.5% for the portion below 1 million yuan.
  3. Compliance Requirements: Taxpayers must strictly distinguish between regular and special invoice issuance to avoid tax risks due to incorrect tax rate selection. For example, issuing a special invoice for real estate rental services at a 3% rate may result in tax supplements and late fees.
