Container House Rental Procedures

Admin September 15, 2026

Renting a container house requires obtaining planning approval and signing a legally valid lease contract. The specific procedures and precautions are as follows:

I. Planning Approval Procedures

According to Article 44 of the Urban and Rural Planning Law of the People's Republic of China, temporary construction within urban and town planning areas must be approved by the urban or county people's government's urban and rural planning authorities. If a container is modified for use as a house, it falls under the category of temporary construction and must obtain approval from the relevant government planning department. Unauthorized use without approval not only violates urban and rural planning but also poses safety risks and may render the lease contract invalid. For example, in a case concluded by the People's Court of Bayuquan District, Yingkou City, Liaoning Province, the lessor's failure to obtain planning approval resulted in the lease contract signed with the lessee being deemed invalid.

II. Key Points for Signing a Lease Contract

  1. Subject Qualification: Clearly specify the names or titles, addresses, and contact information of both the lessor and lessee to ensure legal validity.
  2. Subject Matter Details: Specify in detail the specifications, quantity, and purpose (such as residence, storage, etc.) of the container to avoid disputes.
  3. Lease Term: Clearly define the start and end dates and include provisions for lease renewal and early termination.
  4. Rent and Payment: Specify the rent amount, payment cycle (e.g., monthly, quarterly), and payment method (cash, transfer, etc.).
  5. Delivery and Return: Agree on the delivery location, time, and acceptance criteria upon return (such as condition and cleanliness requirements).
  6. Maintenance Responsibilities: Divide responsibilities for daily maintenance and repair costs, e.g., the lessee is responsible for daily cleaning, and the lessor is responsible for structural repairs.
  7. Breach of Contract Liability: Clearly define the circumstances of breach by both parties (such as rent arrears, unauthorized modifications) and the corresponding compensation responsibilities.

III. Determination of Contract Validity

If a container house has not obtained planning approval, according to Article 3 of the Interpretation of the Supreme People's Court on Several Issues Concerning the Trial of Disputes over Lease Contracts for Urban Houses (Revised in 2020), the lease contract is invalid. However, if approval is obtained before the conclusion of the first-instance court debate, the contract may be deemed valid. Therefore, the lessor should prioritize obtaining approval to ensure the validity of the contract.
