Container House Procurement Contract

Admin September 15, 2026

The container house procurement contract should clearly define core terms, covering the subject matter, price, delivery, acceptance, payment, and liability for breach of contract, among others, and ensure legality and operability by incorporating real-world cases and industry standards.

I. Contract Parties and Subject Matter
The contract should specify the names, addresses, and contact information of the purchaser and supplier, and provide a detailed description of the subject matter. For example, in the procurement project of the Huzhong District Public Security Bureau, the subject matter is a container house produced by Shenyang Wananhe Machinery Equipment Co., Ltd., under the brand name "Wananhe," with specifications of 243*3 meters, a quantity of 1 set, and a unit price of 845,600 yuan. The brand, model, technical parameters (such as material, fire rating, service life), and compliance with national standards (such as Class A fire requirements) should be noted. If customized services are involved, such as in the project of Guangzhou Medical University Affiliated Brain Hospital, the scope of services, detailed design requirements, and acceptance criteria should be clearly defined.

II. Price and Payment Terms
The contract should list the total price and itemized quotations (such as container body fees, transportation fees, installation fees) and agree on payment milestones. For example, the Fujian Expressway project requires the total price not to exceed 855,000 yuan, with clear itemized quotations. Payment methods can follow industry practices, such as installment payments: an advance payment (e.g., 20%) upon contract signing, with the balance paid after delivery and acceptance. Risks similar to those in the Wang Moumou contract fraud case, where the supplier fails to perform after receiving the advance payment, should be guarded against, and performance bonds or installment payment conditions can be set up.

III. Delivery and Acceptance
The delivery time, location, and method should be clearly specified. The Guangzhou Brain Hospital project requires the supplier to complete the design within 3 days of receiving notice and complete production, installation, and acceptance within 12 days. Acceptance criteria should include functional testing (such as water and electricity connectivity), quality inspection (such as fire performance), and appearance checks. If the subject matter is a second-hand or leased property (such as the Zhongyaolu container rental case), it should be noted that delivery is in its current condition, and the lessee should be required to conduct on-site inspections to confirm defects.

IV. Liability for Breach of Contract and Dispute Resolution
The contract should specify breach scenarios and compensation methods. For example, if the supplier delays delivery, a penalty (such as 0.1% of the contract amount per day) should be paid, and if the purchaser rejects qualified products, damages should be compensated. Dispute resolution methods are usually litigation or arbitration, and the governing court or arbitration institution should be clearly specified. Additionally, following the suggestion of Shandong Xiangduoduo Company, the contract can require the supplier to provide raw material inspection reports, factory inspection records, and other documents to reduce the risk of quality disputes.

V. Other Terms
Special terms should be supplemented based on project characteristics. For example, if related-party transactions are involved (such as the service contract between Rizhao Port Co., Ltd. and Shandong Energy Group), the transaction background and pricing basis should be disclosed; if the subject matter is a property without title (such as the Zhongyaolu container), the title risk should be noted, and the lessee should be required to bear it themselves. Furthermore, the contract should comply with the Civil Code and industry standards, avoiding vague expressions (such as "about" or "approximately") to ensure enforceability of the terms.
