Container House Planning Approval
The planning approval for container houses requires application based on specific circumstances, and relevant approval procedures usually need to be completed. Details are as follows:

I. Necessity of Approval If container houses occupy public spaces, engage in business operations, or change land use, they fall within the category of buildings and must be declared for approval in accordance with the law. According to Article 44 of the Urban and Rural Planning Law of the People's Republic of China, temporary construction within urban and town planning areas shall be approved by the urban and county people's government urban and rural planning administrative departments. Container houses built without approval may be identified as illegal structures and face the risk of demolition. For example, transforming a container into a house and placing it in a public area without obtaining planning approval and a land use certificate constitutes an illegal structure.
II. Approval Process
- Site Selection and Land Confirmation: Visit the land bureau to determine the land nature (e.g., whether it is construction land) and sign a land contract.
- Planning Filing: Take land planning-related documents to the local planning bureau to complete filing and approval procedures.
- Temporary Building Approval: Container houses are usually approved as temporary buildings, with a typical approval period of two years, which can be renewed upon expiration. During approval, design drawings and a complete plan must be submitted to ensure compliance with safety, environmental protection, and other requirements.
- Special Purpose Approval: If used for encouraged industries such as creative parks or cultural tourism homestays, government approval documents are required (e.g., Shanghai's encouragement of secondary green modular applications for containers).
III. Exceptions Exempt from Approval If container houses are located within the scope of one's own land use rights (e.g., homesteads or industrial land) and meet the following conditions, approval may not be required:
- They do not disturb residents or cause pollution;
- The ground is not hardened, utilities are not connected, and permanent occupation is not formed;
- They are only used for temporary storage or agricultural material storage without changing the land nature.
IV. Suggestions for Compliant Use
- Business Purposes (e.g., homestays, shops): Obtain land use approval, planning filing, and fire safety permits, prioritizing commercial/cultural tourism land.
- Residential Use: Apply for a construction permit as a formal building, with a floor height not exceeding 6 stories and a total height ≤ 24 meters.
- Temporary Storage on Farmland/Roofs: Avoid hardening the ground, connecting utilities, or changing functions. It is recommended that individual container sizes do not exceed 20-foot standard containers.
