Who Manages Container Houses

Admin September 15, 2026

The management authority for container houses needs to be comprehensively determined based on their nature, purpose, and placement location, potentially involving urban and rural planning departments, township people's governments, urban management law enforcement departments, and land management departments, among others.

1. Legally Constructed Container Houses

If the construction of a container house complies with local planning requirements and has obtained land use rights certificates and planning permits, it is considered a legal structure. Its management primarily follows the general building management regulations, with daily supervision carried out by urban and rural planning departments or relevant competent authorities to ensure its use aligns with the planned purpose and safety standards.

2. Illegally Constructed Container Houses

If a container house has not been applied for through relevant competent authorities or the approved application has not been implemented, and it lacks land use rights certificates and planning permits, it constitutes an illegal structure. In such cases, the management authorities and handling methods are as follows:

  • Urban and Rural Planning Departments or Township People's Governments: According to Articles 64 and 65 of the 'Urban and Rural Planning Law of the People's Republic of China,' for container houses constructed without a construction project planning permit or not in accordance with the provisions of the planning permit, the urban and rural planning administrative departments of local people's governments at or above the county level or township people's governments shall order the cessation of construction, set a deadline for correction; if correction is not made within the deadline, they may be demolished in accordance with the law.

  • Urban Management Law Enforcement Departments: If a container house is placed in public areas or open spaces without obtaining planning approval, it is considered an illegal structure. Urban management law enforcement departments have the authority to demolish it in accordance with the law to maintain urban order and public safety.

3. Management Under Special Circumstances

  • Temporary Storage or Use: If a container house is only used for temporary storage or specific purposes (such as agricultural material storage) and does not change the land nature or result in permanent occupation, it may not be classified as an illegal structure. However, it must ensure that it does not affect urban and rural planning, does not damage land resources and the ecological environment, and avoids triggering legal disputes.

  • Rural Areas: When placing a container house in rural areas, it must be located on one's own confirmed homestead and must not affect rural traffic or the lives of other villagers. If placed on wasteland such as barren hills or slopes, prior consultation with relevant land management departments and obtaining government approval are required.
