Is Container Housing Allowed in China?

Admin September 17, 2026

The legality of container housing in China needs to be comprehensively judged based on specific circumstances and multiple legal provisions. It may be legal if it meets relevant requirements, and illegal otherwise.

From the perspective of land management, according to Article 57 of the Land Administration Law of the People's Republic of China, for the temporary use of land for construction projects and geological exploration, approval from the competent natural resource authorities of the people's governments at or above the county level is required, and no permanent buildings shall be constructed. If container housing is used as a temporary building and has obtained legal approval, it meets the land management requirements.

In terms of urban and rural planning, according to Article 40 of the Urban and Rural Planning Law of the People's Republic of China, for building construction within urban and town planning areas, an application for a construction project planning permit shall be submitted to the competent urban and rural planning authorities. If container housing is located within a planning area and has obtained the relevant planning permit, it meets the urban and rural planning requirements. At the same time, as a building, the construction of container housing must comply with the provisions on building permits in this law. Those who fail to obtain a construction project planning permit or construct without following the regulations may face orders to stop construction, rectification within a time limit, fines, or demolition.

Regarding land use control, if container housing changes the land use and has not gone through the approval procedures for converting agricultural land to non-agricultural use, it constitutes illegal land use.

In rural areas, if container housing is used as a residence and complies with the overall land use plans of townships (towns) and village plans, and has obtained approval for homestead use, it may be legal. If it is used as a temporary and movable building facility and does not affect the implementation of short-term construction plans or regulatory detailed plans, as well as traffic, city appearance, and safety, it may also obtain approval for temporary construction. For example, in a case handled by the Comprehensive Administrative Law Enforcement Team in Lvxiang Town, Jinshan District, a restaurant owner placed a container behind the house as temporary housing for employees. Since it was not approved and no procedures were followed, it was identified as illegal construction.
