Land Application for Container Houses

Admin September 16, 2026

When applying for land for container houses, it is necessary to go through approval procedures in accordance with local regulations based on the nature and purpose of the land. Unauthorized placement without approval may constitute illegal construction.

Confirming the Land Nature is Fundamental

Different types of land have varying requirements for placing container houses. For construction land, planning permits may be required. Agricultural land is strictly prohibited from being arbitrarily repurposed for placing container houses, as its primary use is for agricultural production. For example, building a container house on contracted forest land is essentially converting agricultural land into construction land, which must be approved by the forestry administrative authorities in accordance with the law. Unauthorized construction without approval is illegal.

Consulting Local Relevant Departments is Crucial

Different regions have varying regulations regarding temporary buildings or container houses. Urban and rural planning departments and land management departments can provide the most accurate policy information and guidance on the application process. For instance, in some places, container houses are regarded as temporary buildings, and no building permit is required, allowing for free erection and dismantling. In other places, they are considered illegal buildings and fall under the category of illegal construction. Coastal cities are more accommodating towards container houses. Cities like Shanghai and Shenzhen have introduced special policies to encourage their use in the cultural tourism and commercial sectors. Some major agricultural provinces have strict controls. For example, a new regulation in a certain province in 2025 requires that container houses in fields must go through temporary building registration procedures, even if they are only used for storing agricultural tools.

Clarifying the Purpose and Using in Compliance

If used for temporary storage on farmland or rooftops, the ground should not be hardened, no water or electricity should be connected, and only agricultural supplies and tools should be stored. A single 20-foot standard container is the least likely to be questioned. If used for commercial purposes such as homestays or shops, procedures such as land use approval, planning registration, and fire safety permits are required. Priority should be given to commercial and cultural tourism land, and areas under farmland protection should be avoided. The structural safety should comply with relevant regulations. If used for residential purposes, it should be declared as a formal building, obtain a construction permit, with a height limit of no more than 6 floors and a total height of ≤24 meters.
