Requirements for Building Container Houses
Building container houses must meet three requirements: compliance with land nature, proper planning approval, and adherence to construction standards:

Compliance with Land Nature: Rural homesteads belong to collective construction land. If container mobile homes are used for residential or commercial purposes, it must be ensured that the land nature is that of a homestead or that approval for converting agricultural land has been obtained. According to the Land Administration Law, unauthorized construction on cultivated land will face the risk of demolition. Homesteads must pass the “one household, one homestead” approval process, and the area must not exceed local standards (for example, Guizhou stipulates that each household must not exceed 320 square meters). If used for non-residential purposes (such as warehousing or processing), separate application for collective commercial construction land quotas is required.
Proper Planning Approval: If used as a permanent building, it must be included in rural construction planning. According to the Ministry of Housing and Urban-Rural Development's “Technical Policy for Rural Housing Construction”, rural housing should generally not exceed 3 floors, with a floor height not exceeding 3.3 meters. For example, a homestay cluster in Anji, Zhejiang, formed a double-story LOFT structure by horizontally splicing 6 containers. Due to submitting the design plan in advance and obtaining approval, it became a legally operated commercial building. If used as a temporary building (such as for post-disaster relocation or construction site shelters), some regions allow exemption from planning permits for 1-2 years, but self-demolition is required upon expiration of the use period.
Adherence to Construction Standards: Container mobile homes must meet structural safety and fire protection requirements. According to the “Code for Fire Protection Design of Buildings”, container mobile homes used for residential purposes must use Class A fire-resistant materials (such as rock wool boards), and the building area of each unit must not exceed 300 square meters. For example, a container street market by the river in Shanghai was included in the “small catering registration” pilot program due to its use of flame-retardant materials and passing fire protection inspections. In addition, the foundation requirements for container houses vary by type: folded container houses and fixed residential container houses only require leveling of the ground; packed container houses have simple foundation requirements and may not even require a foundation; while residential mobile panel houses require pouring of concrete foundations.
