Is Approval Required for Container Houses?

Admin September 15, 2026

Container houses require approval.

Necessity of Approval:

  • Legal Aspect: According to Article 44 of the Urban and Rural Planning Law of the People's Republic of China, temporary construction within urban and town planning areas must be approved by the urban and county people's government's urban and rural planning authorities. If container houses are used as temporary buildings, occupying public spaces or engaging in business transactions, they fall within the scope of buildings and must be declared for approval. For example, in a container house rental case adjudicated by the Beijing Second Intermediate People's Court, the court explicitly stated that container houses constructed without approval are illegal temporary structures, and the relevant rental contracts are invalid.
  • Safety and Planning: Unauthorized container houses may disrupt overall urban and rural planning and pose fire safety and structural hazards. For instance, in a case handled by the Jinshan District Lvxiang Town Comprehensive Administrative Law Enforcement Team, a restaurant owner converted a container into staff quarters without obtaining the necessary permits, resulting in the structure being deemed illegal and ultimately requiring rectification.

Core Conditions for Approval:

  • Compliance with Land Use: It is necessary to confirm whether the land use (such as construction land or homestead land) permits temporary structures and to obtain a land use certificate. For example, constructing a container house on homestead land requires applying to local planning and land authorities for supplementary rural construction planning permits and other procedures.
  • Building Safety and Fire Protection: Container houses must meet building safety standards (such as structural stability and earthquake resistance) and fire protection regulations (such as ventilation and escape routes). If modifications involve water supply, electricity, or air conditioning installation, approval from relevant authorities is required.

Consequences of Non-Approval:

  • Risk of Contract Invalidity: If unauthorized container houses are used for rental or business purposes, the relevant contracts may be deemed invalid due to violation of mandatory legal provisions.
  • Forced Demolition and Penalties: Urban management authorities may legally demolish illegally constructed container houses and require restoration of the land to its original state. For example, 'group-purchased' container houses in Miaozhong Village, Chongming District, were deemed illegal due to lack of approval and faced the risk of demolition.
