Adding One Floor to a Container House

Admin September 17, 2026

Whether adding one floor to a container house is compliant depends on whether the corresponding construction project planning permit has been obtained. Those who fail to obtain the permit or construct in violation of the permit's provisions may face legal consequences such as being ordered to stop construction, being fined, and being required to demolish the structure within a specified time limit.

If you need to legally add a floor, you need to apply for different permits based on the type of planning area:

1. Urban or town planning areas: You need to apply to the urban and rural planning authorities for a construction project planning permit. When applying, you must submit land proof documents, such as land use right certificates or relevant land ownership proofs, to clarify the legal use nature of the land. At the same time, you need to provide a detailed design plan, including key information such as the building structure, layout, and height after adding the floor, to ensure that the design plan complies with local planning requirements and building codes.

2. Township or village planning areas: You should submit an application to the township government, which will then report to the county-level planning department for the issuance of a rural construction planning permit. Moreover, the floor addition construction must not occupy agricultural land. If it is indeed necessary to occupy agricultural land, you must first go through the approval procedures for the conversion of agricultural land to non-agricultural use. Only after obtaining approval can you proceed with subsequent planning and construction work.

In addition, special attention should be paid to structural safety issues when adding a floor to a container house. For example, if a steel structure design is adopted, it must be ensured that it has sufficient load-bearing capacity to withstand the increased weight and various loads after adding the floor, so as to avoid safety accidents caused by insufficient structural strength. During the construction process, a concrete foundation should be poured to bear the stacked weight and ensure the stability of the entire building. If the legal procedures are not followed, even if new building forms such as container houses are used, they may still be identified as illegal constructions and face corresponding legal penalties.
