Container House
Transferring ownership of a container house requires legality confirmation, a proper sale process, and the usual title-transfer steps, as follows:

1. Legality confirmation
Before transfer, confirm that the container house is lawful. If planning approval was never obtained or there is no land-use certificate, it is an illegal structure and cannot be transferred legally. Under China’s Urban and Rural Planning Law, a lawful building must have planning permission and a clear land use (for example construction land or temporary land). If the house is a temporary building, confirm that its permitted use period is still valid so an expired term does not block the transfer.
2. Sale process
- Price declaration: Under Article 35 of China’s Urban Real Estate Administration Law, when transferring real estate the parties must truthfully declare the transaction price and must not understate or overstate it. Although a container house is not a traditional property, the same rule still applies—report the actual sale price to the relevant department of the people’s government at or above the county level.
- Sign a sales contract: Buyer and seller must sign a formal contract that clearly states core terms such as location, specifications, price, payment method, and delivery date. The contract should meet the requirements of the contracts book of China’s Civil Code so both parties’ rights are protected by law.
- Complete transfer formalities: After the deal closes, complete the transfer under local rules so ownership moves lawfully to the buyer. If the house is attached to land, also change the land-use rights; if it has independent title, only the house title needs to be transferred.
3. General transfer steps
- Prepare documents — Title proof: property certificate, real-estate title certificate, or planning approval documents (to show legality). Identity proof: valid IDs such as national ID cards and household registration booklets for both parties. Other materials: depending on local rules, a land-use certificate, temporary building permit, transaction contract, and similar papers may be required.
- Submit application and review: Both parties go together to the local real-estate transaction center or real-estate registration center and submit the transfer application and materials. The authority verifies that title is authentic and lawful and that the property may be listed for transfer (for example, no mortgage or court seizure).
- Pay taxes and fees and register — Tax payment: based on floor area, sale price, and related factors, pay deed tax, stamp tax, and other charges. Rates vary by region and must follow the local tax authority. Transfer registration: after taxes are paid, the registry moves title from seller to buyer and issues a new title certificate.
Tip: Container-house transfers involve law, planning, tax, and other steps. Consult the local real-estate registration center or a lawyer in advance to keep the process compliant.
