Can the Toilet Upstairs Be Moved?
Generally, the toilet upstairs cannot be moved arbitrarily, as it involves legal risks and requires meeting various conditions.

Cases Involving Changes to Building Structures
If moving the toilet upstairs involves changes to the main building structure or load-bearing components, according to Article 15 and Article 69 of the Regulation on the Administration of Construction Project Quality Management, such renovation projects must have design plans proposed by the original design unit or a design unit with the corresponding qualification level. This is because changes to the main building structure and load-bearing components directly affect the overall safety and stability of the building. If construction is carried out without a professional and reasonable design plan, it will pose a serious threat to the safety of the entire building. Once unauthorized construction is discovered, the relevant departments will order rectification and impose fines of not less than 50,000 yuan but not more than 100,000 yuan on individuals, and fines of not less than 500,000 yuan but not more than 1,000,000 yuan on units.
Cases Involving Changes to Room Functions
If a room without waterproofing requirements is converted into a bathroom, according to Article 5 of the Measures for the Administration of Interior Decoration and Renovation of Residential Buildings, such behavior is explicitly prohibited. A bathroom is an area with frequent water use and requires comprehensive waterproofing measures, while rooms without waterproofing requirements usually do not have such conditions. If a room without waterproofing requirements is forcibly converted into a bathroom, it may lead to water leakage problems in the rooms downstairs, affecting the normal life of the downstairs residents. Violators of this regulation will be ordered to make corrections by the urban real estate administrative department and fined not less than 500 yuan but not more than 1,000 yuan for the renovator, and fined not less than 1,000 yuan but not more than 10,000 yuan for the decoration and renovation enterprise.
Aspects of Adjacent Relationships and Property Management Regulations
Even if the relocated bathroom has proper waterproofing and sewage discharge measures, it cannot be moved arbitrarily. Approval from neighbors and the property management is also required. Otherwise, disputes may arise due to violation of the principle of adjacent relationships (Article 288 of the Civil Code). In addition, if the property management regulations of the residential community explicitly prohibit unauthorized changes to the building structure or function, moving the bathroom upstairs privately will violate the property management regulations.
