Can Prefabricated Houses Be Used as Restaurants?

Admin September 18, 2026

In theory, prefabricated houses can be used as restaurants if they have complete procedures, are structurally safe, and their locations comply with environmental protection regulations. However, a comprehensive assessment based on specific conditions is necessary.

1. Legal Procedures Are the Basic Prerequisite

According to the Civil Code of the People's Republic of China and the Law of the People's Republic of China on the Prevention and Control of Atmospheric Pollution, a house used for commercial purposes must have legal procedures, including planning approval and construction permits. If a prefabricated house has not gone through the relevant approval process and is considered an illegal structure, it cannot obtain a business license and will directly lose the qualification to open a restaurant. Therefore, the legality of procedures is the primary condition for determining whether a restaurant can be opened.

2. Building Safety Requires Strict Assessment

Prefabricated buildings have potential safety hazards due to their structural characteristics, such as poor earthquake resistance and easy cracking of floor slabs. Restaurant operations involve a large number of people, heavy equipment loads (such as kitchen equipment and storage), and must meet fire safety requirements (such as evacuation routes and fire compartments). If the structural strength, load-bearing capacity, or fire protection facilities of a prefabricated house do not meet standards such as the Code for Fire Protection Design of Buildings, it may be prohibited from being used for restaurant operations. It is recommended to commission a professional institution to conduct a structural safety inspection and carry out reinforcement or renovation based on the results.

3. Location Must Comply with Environmental Protection Regulations

According to the Ecological Environment Code of the People's Republic of China and the Law of the People's Republic of China on the Prevention and Control of Atmospheric Pollution, the following areas are prohibited from establishing new catering projects that generate oil fumes:

  1. Residential buildings: Including pure residential buildings and the residential floors of commercial-residential complexes;
  2. Commercial-residential complexes without dedicated exhaust ducts: Even if located on commercial floors, if no independent exhaust duct is designed, a restaurant cannot be opened;
  3. Commercial floors adjacent to residential floors: For example, in a commercial-residential complex, if the commercial floor is directly adjacent to the residential floor and there is no effective isolation measure.
    If a prefabricated house falls within the above prohibited areas, it shall not be used to open a restaurant. In addition, some regions may have additional regulations on the distance between catering projects and sensitive areas (such as schools and hospitals), which need to be verified in advance.

4. Local Regulations Require Additional Attention

Some regions have additional restrictions on the use of prefabricated buildings, such as seismic design codes and building lifespan requirements. For example, certain cities explicitly require that prefabricated buildings shall not be used in places with a large number of people or must go through a special approval process. It is recommended to consult local market supervision, housing and construction, and environmental protection departments in advance to confirm whether the prefabricated house meets all compliance requirements and avoid operational risks due to policy differences.
