Can Mobile Toilets Be Dismantled?

Whether mobile toilets can be dismantled needs to be judged based on specific circumstances, and not all mobile toilets can be dismantled at will.

Dismantlable Scenarios

• Illegal Structures: If a mobile toilet is an illegal structure, such as being built without approval, occupying farmland, or exceeding the boundaries of a homestead, for example, occupying public corridors or affecting the village appearance. According to the Land Administration Law and the "Three Clearances and Three Demolitions" policy, such mobile toilets can be legally dismantled, with the law enforcement entities being township people's governments or county-level natural resource departments.
• Safety Hazards or Hygiene Issues: When a mobile toilet is a dilapidated facility with structural safety hazards or does not meet hygiene standards, falling within the scope of "dilapidated houses and dry latrines" specified in the "Three Demolitions", it can also be dismantled, and the relevant responsible parties are required to make rectifications.
• Obstructing Roads and Meeting Illegal Building Criteria: If a mobile toilet obstructs roads and meets the criteria for illegal buildings, it can also be dismantled. However, the dismantling must follow legal procedures and conditions and cannot be carried out arbitrarily.

Non-Forcible Dismantling Scenarios

• Approved and Legally Compliant: If a mobile toilet has been approved and filed, is located within a legal homestead, and meets the Rural Household Toilet Hygiene Standards, it cannot be forcibly dismantled under such circumstances.
• Temporary Facilities Within the Valid Period: For mobile toilets that are temporary facilities and have not exceeded their valid period, if they are approved temporary mobile toilets that are within the usage period and do not affect planning, they need to be dismantled by themselves after expiration and cannot be forcibly dismantled before expiration. This reflects the protection of the usage period of legal temporary facilities and ensures that the legitimate rights and interests of relevant stakeholders are not infringed upon.
