Beijing Container House Approval

Admin September 17, 2026

The approval of container houses in Beijing needs to be carried out in accordance with specific circumstances and relevant laws and regulations, with different approval requirements for different types.

I. Approval Requirements for Different Types of Container Houses

  1. Movable containers without foundations placed within the property boundary: According to the 'Regulations on Urban and Rural Planning in Beijing', applications for planning permits are required for the construction, renovation, and other types of buildings, structures, as well as urban and rural municipal and transportation projects. If such containers are involved in the above situations, an application for a planning permit is necessary.
  2. Permanent or commercial-use container buildings: Used for long-term residence, commercial operations, etc., and regarded as permanent or semi-permanent buildings, an application for a construction engineering planning permit should be submitted to the urban and rural planning authorities.
  3. Temporary container buildings: Temporary construction within urban and town planning areas should be approved by the urban and rural planning authorities of the city or county governments. Temporary constructions should be self-demolished within the approved usage period and should not affect the implementation of short-term construction plans, regulatory detailed plans, as well as traffic, urban appearance, and safety. In special cases, such as temporary office and accommodation facilities on construction sites, which do not change land use, affect urban and rural planning, or public safety, special approval may not be required, but relevant safety and environmental protection regulations must be followed.

II. Approval Process This includes selecting a site to confirm the land nature and clarifying whether the land use meets the requirements for container house construction; taking land planning documents to the planning bureau for filing and approval procedures; designing planning drawings to ensure compliance with relevant norms; and formulating a complete plan that covers various aspects such as construction scale and layout. Construction can only commence after approval is obtained.

III. Precautions The placement of container buildings should not affect urban appearance, traffic, and the environment and must comply with urban planning and renovation requirements. Legal cases have shown that transforming containers into facilities with housing attributes within urban or town planning areas without approval from government planning departments not only violates the overall urban and rural plan but also poses significant safety hazards, and relevant lease contracts may be deemed invalid.
